Green card missing - do I need replacement

Hi,

I arrived in US in Jun 2010 and due to personality conflicts couldnt save my marriage for long.I received the welcome notice letter for the green card but havent received the greencard copy.I called USCIS only to be told my card was lost in mail.I will be getting my divorce decree in another 2 months.So I need to apply for removal of conditions as my marriage was entered in absolutely good faith.However,since i dont have the copy of green card yet,do you think i can apply for removal of conditions with my passport stamp and other evidence? I just want to avoid going through I-90(for replacement) because this card will be shortlived as I need to soon apply for removal of conditions.

Any help is greatly appreciated...

if i am correct, the removal of condition or i-751 applies when you are 2 years through your marriage. the i-751 is submitted a few months before the 2 year expiration of the green card. as you mentioned you only arrived in u.s. on jun. 2010, so the 2 years will be up by 2012. my advise is for you to consult a good immigration lawyer. maybe this website has a list for you to look at. good luck.

To CR1Visa - is there a chance that your soon to be ex husband received your green card and is holding it from you? You will most likely need to have the green card to file for Removal of Conditions, which you should do shortly after your divorce is finalized. You don't need to wait - in fact, you shouldn't wait - until the 90 day window prior to the 2 year green card expiring. You could try filing with the notice and a statement that the card was lost in the mail but I don't know if it would work. You could include a copy of the I-90 with the application instead of waiting for the actual arrival of the replacement green card.

To file ROC you need to include a copy of the front and back of the green card in the petition package. I agree with Kathryn is there a way that he could of found the mail and hidden it from you? or maybe even found it and tossed it out? You will need to get on USCIS about getting the card resent to you or apply for a replacement card.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

When people divorce they can file the ROC right away. No need wait the 21 months as they are basically out of status.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

When you divorce you can file for ROC after you have all the documents for the divorce, you do not have to wait for the 2 year anniversary date. There are many cases on here which are similar to yours, many have already been approved.

Also, you need a copy of your green card for I-751. You can always apply for a replacement green card before you file for I-751.

Thanks Guys for all your suggestions.It is likely that my ex is holding from me and but i can assure that for sure because the welcome notice has been delivered to my new address and not ex.So I dont know if the green card alone went to the old address.

Do you think i can talk to USCIS and explain to them about my divorce situation on the phone or do you think it isnt that advisable?

Also,if i need to work in the meanwhile to get along with my life,wiill the passport stamp of I-551 suffice or do i need the plastic green card for sure??

Hi,

Whenever i call them, USCIS jus raises aservice request .After a few days I receive a mail saying that they sent the card and was not returned back to them.Is the card delivery status upadated in the USCIS Case status info when i key in my receipt no?

Also,can you tell me what all documents go with I-90 as evidence?I am submittting my I-797C and my passport for biographical info.Are those sufficient?Please let me know..
