Hello Fellow Members

Here I am again. I have a question, we received an RFE for Affidavit of Support not meeting the 125% of the poverty line and our option is to add a joint sponsor. My joint sponsor is my father in law who lives in a different state. He retired early this year and do contractual job from his previous employer, so what proof of current income do we need to provide? There was no contract between him and the company and they pay him everytime he do work for them. Basically checks comes in regularly. Are bank statement enough to prove that he has consistent income flowing into his account? Second question is... is it ok to just send his Form 1040 and W2 from last year 2009 since it would take a while to get his 2007 and 2008 tax transcript? Any advice and help will be greatly appreciated.

So, he's basically a self-employed contractor now. Yes, he should include bank statements. Does he get a statement with the checks? If so, he should include some of those. If he can, he should also try to get a statement, on company letterhead, from the company he's doing contract work for, stating when he started doing contract work for them and how much he's been paid so far.

When he enters his annual income in part 6 he should annualize what he's receiving as a contractor, in addition to any other income he's receiving. In other words, he shouldn't just project how much he's going to make this year since his income this year will include wages from the job he doesn't have any more. He should figure out how much he's making on average NOW, and determine how much per year that works out to.

He only needs to send his tax return for the most recent year. They may send an RFE for an additional two years of returns, since his current work situation is relatively new. It only takes about 10 days to get transcripts from the IRS. If he's got a FAX machine he can get them in one day.

Hi Jim...here I am again... first of all thanks for all the advice they have been very helpful and I have learned a lot here in VJ that I share to others who are doing the same process as I am. I have one more question... it might take a while before my father in law finishes up the paper work and its a little bit hard for me to help him since he lives in a different state. Anyway... do have an idea about militaries LES? Leave and Earning Allowance i think thats what they call it. My brother in law who is in the navy is also willing to co sponsor however when you look at his tax forms they are below the 125% poverty guidelines since we are not spouse and child we should use the 125%, however he has LES ... housing allowance, leave and others that are being paid and are not taxable. I tried calling the 1800 twice to ask about this but it seems that they have no idea of what I'm talking about. If you include this he is getting more than what is required. He actually receives almost 70K annually but his taxes for the past 3 years only reported around 30 to 35K since half of what he is getting is allowance and not being tax. I am not sure how this can help and where to put them in the I-864 forms. Would you know something about this? Any advise will be appreciated ... thank you very much
