Timeline

My husband had his interview in morocco 2 days ago n was denied because the officer did nt belive we had a relation even though we have been together for almost 5 years and we have been married for a yead and three months I have already contacted my congressman and senator what should I do next should I get a lawyer or should I just start the process all over again plz let me know thnx I appericate any help I get thnx alot

You need to find out why they dont believe your relationship is real before you start over again. Fix whatever that is and then move forwards.

You need to go through the interview questions. Find out EXACTLY what was said. That's the best way to get an idea of the reason they probably had for the refusal. What did the refusal worksheet say? Also, try contacting the consulate...see if you can get a reason, or atleast find out if the case has left yet. If it hasn't left then u may have a chance of fighting to reopen it, but u can't do that without having an idea of why they refused u. Hope this helps a little bit.

Go over the interview questions. What are the possible red flags? A lawyer really can not help you right now....only take your money. You can't re-file right now, you filed a CR1 and if it's returned USCIS will have to review it. If it's still at Casa try to fight it now.

01/2006 - Filed k1(1st time)

04/2006 - Interview (1st time) denied

Waited, waited...... no review

06/2009 - Filed k1 (2nd time)

09/2009 - NOA 2 approved

12/2009 - Interview (2nd time) APPROVED! VISA ISSUED

02/2010 - Arrived USA

04/2010 - Married

4/19/2010-Sent to Chicago Lockbox

4/26/2010-Received texts and emails 7th day

4/30/2010-Received NOA's(Hardcopies) 11th day

5/3/2010-Received ASC appointment notice(mailed 4/29/2010)14th day

The Consulate doesn't actually deny these visa applications. They just refuse to issue the visa and send them back to USCIS for reccomendation for denial. It is up to USCIS to actually re-affirm the application or deny it. It any case~ it can take up to about three months for your case to get back to USCIS once it leaves the Consulate. I have not seen many senators lately successsful in getting a second look at the case before it is sent because usually the consulate just responds that it has already left....sometimes even when it hasn't, but most people reccomend to get your senator involved now anyway. Once USCIS receives your case back, they will say that a review of your case will take up to 120 days. This 120 days doesn't begin until your case is actually back at USCIS. So if your case actually does leave the Consulate.....it could take up to 7 months for a review....maybe less. In case you are issue a NOID (notice of intent to deny), you need to look at what could possibly have affected your case. Do you have any red flags such as large age difference, short infrequent visits, etc? What questions were asked in the interview? What did they ACTUALLY SAY to him? You will need to adress all these issues.

I'm sorry this is happening to you. On the up side, at least your case does HAVE to be reviewed. Hang in there.
