Hi,

I will be removing condition on December 2011 and send the package at the end of August 2011.

Here is our situation.

SEPT 2009 - AUGUST 2010

-I moved in the apartment that my husband leased before we even met and when I moved in the landlord didn't want to add my name on the lease because the occupancy was allowed for 1 person only for that price so we lived from September 2009 to August 2010 in a place where only his name was on the lease. All my mail (paystubs, insurance and bank account where delivered there though). What the immigration will think about this situation?

-We added my name to some utilities but only for around 3 months. We thought about that a little bit late and joined our bank account at around the same time (July 2010). We really have few utilities together maybe 2 or 3 with both our name. Is that too little to cover Sept 2009 to Sept 2010?

AUGUST 2010 - present

-we decided to leave the apartment and rent a room (well a big huge room bigger than the studio where we were living before in NYC) because it was making more sense in terms of savings. Hopefully we can put aside some money for a down payment in the next 2 years. We don't have a lease in this new place, we are just renting month by month. How can we prove to immigration that we live together if now none of us has a lease? Utilities are all set by one of the people who is leasing and we have only the cable under both our names.

-Insurance: both our employers provide competitive insurance so my husband and I have our own.

-taxes: no problem we have been filling jointly since 2009.

-we don't have a car

-we didn't travel at all since we got married to save money

How are we gonna provide more evidence? Please give me some suggestion....we don't feel in a confortable situation!

Get signed affidavits from people that know about your marriage.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

It sounds like you have plenty. Here's a couple more suggestions:

Bank statements? Gifts to each other? Photos together? Cards sent by relatives to both of you? Cell phone bill with both your names on it?

It's better to have proof of this type of thing going back and that you're not creating evidence AFTER the immigration officer asks you to prove comingling of finances.

I would recommend you get them dated as close to the date you actually send them in.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

-We don't have a contract, we use metro pcs (I can call for free my family 24h) and we pay on a monthly basis.

-banc statement....we are joint only since July 2010!

Does your bill show two lines? Can you show you both contribute to pay bills for the household? Having a joint bank account is great. If you are required to go to an interview and can show that you ARE sharing finances that is wonderful.

The posters that come on AFTER the interview and ask what they can use to prove their marriage are in a hard place. AFTER the interview is too late to begin creating proof because the interviewer will specifically want proof from before the interview. Since you have proof from before you will probably be alright.

Some ideas I have for me and my husband:

Show delivery receipt in both of our names for the mattress we just bought.

Keep receipts for the Christmas present I have planned - a ski day and possibly lessons for both of us and my 8 year old son.

Show receipts for things he has bought my son, like sending money from his personal account to the district's lunch program, etc.

Good job on getting prepared! I hope your ROC process is over quickly!

one of the bits about ROC deals with 'co-mingling of finances'. Usually, that is shown via JOINT ACCOUNTS - bank, utilities, telephone, etc, where BOTH NAMES are on the 'paper that you receive each month'. Much of this 'paper' is electronic these days, but can still be printed out, in lieu of postal delivery.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

We are in a similar situation - sharing an apartment with a roommate, no formal lease. We live in NYC where this type of 'creative' arrangement is common since it is so $%%^*( expensive to live here - hope local conditions will be taken into consideration. We do have joint tax returns, state IDs showing same address, joint bank accounts, DH is beneficiary on my life insurance/retirement accounts and gets health/dental ins through my job. We also took a trip to India this past summer and will hopefully visit my family for the holidays so will include itinerary with both our names.

You people are overthinking this.

it's not required to attach any possible form of contract to the I-751. What they want to see is SOME proof that you guys actually live together.

Joint tax returns are good, a joint bank account is good, or a joint credit card, but if you don't have a lease together doesn't mean the end of the world. There are many ways to document that you live together. It's not like they are trying to deny your application. Only people who have pretty much nothing, no lease, no joint taxes, no joint bank account, no joint credit card, no car, no insurance in both names, have to be worried. The OVERWHELMING majority of ROC petitions gets approved without a snafu.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . .
