We went to social security office yesrerday, were disappointed, for the following reasons.

1. When my fiancee entered the SFO POE, they have entered wrong date of birth, so it needs to be corrected. How does one do it?

In a day or two we are planning to send all the documents for AOS.

2. My fiancee's daughter on K2 visa was not given social security number. The official said that she needs

to get EAD first before she is issued social security number. Is it true?

If any of you have information about the above, I appreciate your help

Hi,

I dont know getting the date of birth changed- I presume you mean on the I-94? I would think to include a letter in your package explaining the mistake- but someone with more experience may be able to help you more.

You dont need a SSN to apply for AOS. I went to give it a shot getting mine last week- but likewise I was told I have to wait for my EAD. I entered the US on a B-1 visa, so am not eligible for a SSN on that. It does make sense, the SSN is for tax/work purposes, so if you cant work you dont need one.

1. If you are talking about her DOB being incorrect in SAVE when the SSA office tried to verify her status, nothing to correct. They will just send a Form G-845 to immigration to verify her status. Her DOB for the SSN application should come from her birth certificate.

2. K-2s need and EAD card or wait until the AOS is approved and the child is issued an I-551 stamp or card. In the meantime, if you don't want to spring for the EAD card apply to IRS for an ITIN when tax time comes.

Spouse or child will not need an SSN for the AOS to be filed. If either doesn't have an SSN by the time you want to file the AOS just put "NONE" where it asks for an SSN.

If the SSA office does send the G-845, suggest that she go back to the SSA office no more that once week with your documents to (1) ask if they sent a G-845 (2) if yes, did it come back (3) after 30 days ask if they have followed up on the G-845 by calling or sending another mark “second request.”

DHS should respond to SSA within 15 federal work days after receiving the Form G-845. If DHS does not respond within 15 federal work days from the receipt of the G-845 from SSA, follow-up with the DHS, USCIS Immigration Status office. (Allow 15 days plus five additional federal work days of mail time for the G-845 to be received at and returned from DHS. Follow local practice to follow-up with DHS.

Some SSA offices have an arrangement with the DHS, USCIS office to telephone for the follow-up contact; other SSA offices send a copy of the original G-845 annotated “second request.”) If the DHS response is still not received within 15 federal work days after the follow-up contact (if the follow-up is by mail allow five additional federal work days of mail time for the G-845 to be received at and returned from DHS), make a second follow-up contact. If the DHS response is not received within 15 federal workdays (again, if the follow-up is by mail, allow five additional federal work days of mail time for the G-845 to be received at and returned from DHS), after two follow-ups, contact the Regional Office (RO). Also report to the RO any trend that shows a serious deviation by DHS from the above time frames. The RO will consult with central office.
