USCIS-CSC background check delayed the case

Timeline

I have filed, I-129f petition for my fiancee on 2-12-2010. It was received by USCIS-CSC on 2-16-2010. Receiving notice was mailed and I received on 2-20-2010. Since then I have not received anything. Normal Processing time for the case is 5 months and mine has reached the 7 month and we are into 8th month. I have contacted USCIS-CSC through National Customer Service Center and through follow-up email address listed at the USCIS website and every time I get response back is that subject case is pending due to back ground check and you will receive a decision with in 90/120/180 days. Every response has it's different time frame to get the decision with in. I contacted the both California State Senator's offices and they received the same response. Now finally I have contact the CIS Ombudsman's office for help and they have told me they will get back to me with in 45 days, which means more wait and delay. What can I do???? Can I do anything to speed up the case. Is this happening to me because I have divorce from previous marriage and I filed new petition so quick or it is due to my criminal record about 7-8 years ago???. Anyone have any idea what can be done in this situation. PLEASE SHARE the info, if you are experiencing the same problem

I am going on ONE year since my NOA1 due to a "background" check. I have also written my senators and they responded the same saying there is nothing they can do and that background checks can theoretically take as long as necessary and NOBODY can speed it up. I have read that it can take up to TWO years but the law gives them all the time in the world they want. I know it is because of a criminal issue that I disclosed in my application that although did not result in any kind of conviction (nor did I have to answer "yes" to any of the questions -but disclosed it anyways), they are doing the "background" check. It is incredibly, incrediby frustrating. I have scheduled an InfoPass appointment to go in person to a local USCIS office and try to talk to somebody about what is going on and when I could reasonably expect to hear something.

10-01-2009: I-129F sent via return receipt certified US mail

10-06-2009: I-129F NOA1 harcopy

11-05-2009: I-129F RFE

11-17-2009: RFE Reply

01-17-2010: Biometrics appointment

04-05-2010: NVSC response: "The processing of your case has been delayed. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact customer service at the number provided below."

04-09-2010: Senator(s) contacted:

04-21-2010: Response from Senator: "FBI doing name and backgrounds check. US Senator cannot do anything to expedite this petition."

04-23-2010: Response from second Senator: "Has contacted USCIS on my behalf. Please allow 45-60 days in order for this Senator's office to respond to your request."

05-17-2010: Letter written to USCIS director, VSC

05-24-2010: Touched

08-04-2010: Face to face meeting in Turkey; 35 days wonderful days in Istanbul!

09-08-2010: Documentation sent in regarding face to face meeting

09-11-2010: Touched

09-24-2010: USCIS letter states that petition undergoing routine security checks resulting in a delay. No definite indication of when it will be completed."

11-17-2010: Touched: RFE Response Review

01-31-2011: Petition denied

03-02-2011: Appeal filed with AAO

In the past week, you've posted a new thread containing this SAME information FIVE separate times. I'm sorry you don't like the answers that you're getting, but unfortunately they're true. You've contacted everyone you can, no one can speed up the process for you. It sucks, but you'll just have to wait it out. Posting this same thread over and over again is not going to help.

there is nothing you can do it took us two years to receive noa2.....at this point it could be you or the s/o that is being checked i found out after his interview it was all about him

find something to do that gives other things to think about and stay busy is the best advise i can give you
