So forgive me as I haven't had time to scour through all the posts or the complete guidleine so help is uber appreciated. I plan on marrying Jan 8 2011 and filing for AOS as soon as we receive our marriage cert. I believe approx 3 weeks later. I was under the impression that if you filed for AP at teh same time as EAD and AOS there was no extra fee, is this true? If there is a fee, how long should I expect AOS to take (I'm will be in the Buffalo area, we have a "simple K1 case, no kids, no prev marriages, way above 125% poverty line, been dating for 3yrs with lots of proof of both families beign aware etc.)? The reason I'm asking is that my cousin is getting married on Sept 24th 2011 and I need to know if I should apply for AP or not....I can't miss his wedding or he'll be crushed. He found out that AP was possibly for me so he expects me to do that to make sure I can make it but I'm afraid of teh cost....please advise, thanks!

Filing the ead and ap with the aos is free as long as you do it all together. as for timelines most ppl get their ap withing a couple of months so you should be safe for a september visit back home. Of course this is with no changes to the system between now and january which is still a few months away.

I believe the 3 forms are I-765, I-485, I-131 are they any other forms that I will need to complete for my AOS package? Other than going for my SSN is there anything else that I will need to do when I enter the US and after we marry?

you will have to fill out g-325, and your sponsor will have to fill out i-864 and give you tax returns etc. the guides should explain each part for you. i did the forms one at a time, and assembled each as a packet, with all the separate requirements, including picts and i did an overall cover letter for the whole aos package.

you have some time so just read the guides, look at the examples download the forms to practice filling them out in yoru married name lol. dont be like me and try and put in yoru maiden name :P or initials lol. when your used to writing your name the same way for 36 years it takes a few weeks to get used to the new one :)

Also, the instructions for I-765, I-485, I-131 and I-864 are very self-explanatory and you have plenty of time to read up on everything.

Btw, as long as you have once paid the filing fee of 1010$ for form I-485 (as K-1) you will not need to pay fees for AP I-131 or EAD I-767 if you file for it later.

THanks everyone, a lot is going on at the same time and we are having a full blown wedding (which I have oh about 4 weekends to plan due to other commitments....)in just 7days from POE so I wanted to get my feet wet so there were no surprises once I started filling everything in!

One more thing - make sure to check if all your forms are still up to date/valid when you send them in.. we had a lot of RFEs due to outdated forms last month.. :wacko:

If you file the I-131 (AP document application) and I-765 (EAD application) at the same time as your I-485 (AOS application) there are no additional fees - the $1010 for the I-485 covers the other two.

USCIS's stated goal for AOS processing is 6 months, but a lot of people are seeing them in 3-4 months these days.

You should apply for the AP document: the form is simple and it's free, so there's no reason not to. But you will almost certainly have your GC, let alone your AP documents, long long before Sept 24, 2011, so you should be fine.

If you are entering on a K-1 visa, those three forms are the only forms you need to file for your AOS. You should go apply for your SSN about 2 weeks after you enter on the K-1, and before you get married. On the SS-5 application form, indicate that you are an alien authorized to work, and you should have no problems. If you wait until after you get married, or until within 2 weeks of the expiry of your I-94, the SS office may refuse to give you a SSN until your EAD shows up.

You may also want to look into getting a local driver license, but that's pretty much that as far as official paperwork is concerned.

Those forms are supplemental information forms that you include as supporting documentation for the I-485.

The G-325A is personal information, filled out by you.

The I-864 is an affidavit of support, filled out by your sponsor, in which they establish and document that they have enough income and property to support you, as part of their household, above the poverty line. You include this with your I-485 so the adjudicator can check off one of the main conditions required to approve your AOS - that you are not likely to become a public charge.

Both of these forms are filled out at the same time as the I-485, I-765, and I-131, and included with them, along with all of the other supporting documentation, when you mail in your AOS application packet.

FYI: You'll get more answers, of higher quality, quicker, and your posts will be far more useful to the others that come after you, if you make your own new threads for each question instead of burying them at the bottom of someone else's thread. :)
