Timeline

Hi guys.

I am engaged to a US citizen and we were finding it hard to find a sponsor for the affidavit of support. We needed one because my US citizen fiance is living in Ireland and we plan to move to US together, so he couldn't sign for me.

Now I'm wondering if the person who agreed to sponsor us needs to file the affidavit for both of us or just me?

Also, would there be any complications about applying for K-1 visa seeing as my fiance is living with me in Ireland and not in US? can he still file to bring me over with him?

October 8th- Sent off K-1 visa package

October 21st- Received email saying we have been assigned to CSC

October 28th- Waiting on NOA1

October 29th- NOA1 received!!!

March 16th 2011- Received email saying petition for fiance has been approved and that NOA2 is in the mail!

April 12th 2011- Waiting on lettter with interview date from Dublin Embassy. Medical scheduled for 26th April

A USC does not need sponsorship as they are not the ones immigrating but simply returning home

Only the non-USC needs a sponsor. And we're also both living in Ireland and applying for my fiance's visa from here without any difficulties. :)

How long has your fiance been living in Ireland? If it's more than 6 months that he's been legally resident you should just get married now and do DCF for a CR-1.

I've been looking up DCF alright, I don't know much about it really. He has been living here for 23 years. He's a dual citizen. I've heard DCF is easier and it's certainly quicker, so not sure what to do at all. any advice would be great. what stage are ye at with visa's?

October 21st- Received email saying we have been assigned to CSC

October 28th- Waiting on NOA1

October 29th- NOA1 received!!!

We're (fiance and I) are in Cavan at the moment. I can't tell you much about the direct filing since we decided to go the K-1 route so we could have the civil ceremony in the US (and then the big wedding later in Ireland. Slangofoil can fill you in on it more, I believe she's done more research on it.

If you look down at the blue writing in my signature that's our timeline. This will tell you how far along people are in the process. We for instance are still in the initial review stage.

My fiance in from Clare, but has been in Cork for the last several years. I spent a couple years there myself for study abroad and a masters (more details in the "About Me" section of my profile). He's arriving tomorrow!

I would strongly encourage DCF. It is quicker, cheaper, and gets you a green card right after entering the states (no AOS process after entry). And by "quicker" I mean MUCH quicker. Like maybe 2 months versus 9-12 (factoring in AOS). With the K-1, you'd have to file the initial petition, wait several months for approval, wait for it to get through NVC to the embassy, go back and forth with the embassy, then come over, get married, get all your paperwork together for AOS, file it, and then wait several months for work authorization and green card. It is not worth it for a couple in your situation, where you're already together, living in the same country.

The K-1 is really for people who do not live in the same country together. Take advantage of the DCF option. Don't torture yourself with the K-1 process, lol.

DCF sounds good so. The only thing that I'm worried about is proof of bonafide marriage because we don't own any houses together or joint bank acc's etc, and we won't have any of these either because we'll hopefully be moving to the US as soon as possible. It does sound like a great option though, I just hope we qualify for it.

Timeline

DCF is easy and quick (look at my timeline). If part of your reason for a K1 is wanting the wedding ceremony in the USA, then just have a quick wedding at the registry office in Ireland, and a big ceremony and reception in the USA later. You don't need much bonafide co-mingling of resources when you are newly married. In fact, in our case, they didn't even ask for any proof.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
