Documents Rejected After the NVC Step

Timeline

Hi,

Wanted to know if someone has experience/knowledge about some of the documents getting rejected (at consulate interview time) for lack of format etc after DOS/NVC has accepted them? I think it can happen but wanted to know if it is common?

My I-864 and my certified copy of my divorce papers got rejected. NVC had both documents and was ok, now at interview my husband was told we had to send a new copy and get a joint sponsor.

Yes, the interview is the final decision. Having said this the denial of immigrant visa is very remote.

Just a few example:

1) One submitted PCC to NVC and NVC validated it. At the Consulate (say PCC is valid for 6 months), if this 6 months time elapsed, Consulate may give 221g to submit a new PCC. It is not denial. It is administrative processing. 221g is missing document.

2) Medical is done just before the interview. If the person has used drugs or communicable disease, the visa can be denied. To overcome it normally it is difficult, but waiver may be needed

There are many items like this...

The above is not to scare anybody. But keep in mind that the interview is the final decision for any visa.

My husband's divorce certficate was not accepted at the time of my IR1 interview. We had submitted the orginal bilingual (urdu/english) divorce certificate issued from the union council. Apparently NVC had no problems with it but the CO at the embassy told me that it was not in the correct format.

I got issued a blue slip with section 221g marked. It asks me to submit two new divorce certificates, one from union council in urdu and another in english from the family court. We are still trying to figure out what format is required.

Loto, the blue slip that i got says that ....'the office is unable to issue you a visa....' so is this a visa denial or is this just the pretty way in which they like to scare people?

It is NOT the denial at all. It is called "missing document" under section 221g. Once you submit those missing document, they will re-consider the interview again. Please note that there is some time period within which you need to submit them. If it exceeds the time limit, the entire process will be canceled. So, act little faster.

It is not a denial - it is just the documents are missing, or some information on document is missing. You can provide the missing documents or information and your are fine. This is not even scare tactic, its just some documents are ok by your standard but Consulate thinks the other way.

So all you need to do is provide the documents and you should be fine and an interview can be rescheduled.

In India there is one more layer after NVC, even VFS people go thru documents, they dont have any say but they can help you with getting right formats and right documents.

I am not sure if that is applicable for pak.

Yes normally to respond to the Consulate will be within 1 year. But don't delay things from your side. Get the documents and courier it. Most probably along with your passport and/or this 'ineligibility' letter. So, they will validate the 'missing' (in fact document that are specific for them) document and stamp the visa on the passport and courier back to you.

Note that they have NOT used the term 'DENIED'.

My husband and I went through the same thing. NVC accepted our I-864 from our joint sponsor and it was rejected at the interview. They gave my husband a blue paper and said find another joint sponsor. We have to send in the joint sponsors I-864 along with my husbands passport.

I called Dept of State and they said we have a year to get the missing paperwork to the embassy but of course we need to get it in as soon as possible.

Well i didnt get my passport back...my son got his visa...

Loto, you are right :) i guess i was being pessimistic...it isn't a denial afterall...i guess something like an RFE...the trouble with our case is that we think that the embassy's asked us for something that does not apply to our scenario...a court certificate for my husband's divorce...anyhow..it is impossible to speak to someone at the embassy ..i have been trying non stop since the last two days...we've consulted a lawyer and hopefuly everything will be sorted out soon...

It is called AP - Administrative Processing. Holding your passport at the Consulate is again a positive thing. This means they are ready to issue the visa when you submit the document that they requested.

In some cases, passport will be returned to the applicant and come back later.

If the joint sponsor is inadequate or the documents are not properly formatted, then NVC should tell us in the first place. They just make us go through the entire process only for us to know in the end that we need to find another joint sponsor or our documents are incorrect. This tells us that NVC don't really care. They only want our money. I feel sorry for supermom82. I am really worried now. I have used a joint sponsor. NVC need to do a better job.

That happened to my husband on his interview date. He was fingerprinted, told ot swear an oath, and paid the money for the visa that day. They also took all documents needed that day. The only problem that day was that the CO rejected our joint sponser because they claimed that it wasn't an "original". He was told to take his passport and that when we sent in the original they would ask for his passport to stamp the visa on it. Now its been almost 5 months since that day. We sent in a new joint sponser two weeks ago and are hoping for the best.
