I am trying to get information for my wife on filing for AOS for herself and son. I have not been able to find out anything about this and hope someone has had a similar situation.

Son is 17.

I-485 one for her and one for him

on her I-485 she has listed her son is applying with her is this correct?

Also for her she was associated with The Communist Union of Youth, she was only required to do this because of school and work never attended any sort of meeting

She has listed on Part 3 C I am sure she needs to do and with that she would also have to answer yes to Part 3 Processing Information question 6.

I-485 On son's application what A# would he have because he did not get one do I just have her put none or use hers?

Other then a copy of marriage license and I-797 for approval notice of K-1 visa is there anything else from her I-485 documentation need to be added to his his?

Now a question I have with I-864 Affidavite of Support

I have marked on Part 3 box 9 and put stepson's name on 9a would I just make a copy of this and put in his application for AOS? I know he diffently not the principle immigrant,

so not sure what to do here. The only example I saw is just with wife and nothing with additional individuals.

Thanks for any help

Correct, and their fees are $2,020 ($1,010 x 2 AOS applicants between 14 and 79 years old)

Also for her she was associated with The Communist Union of Youth, she was only required to do this because of school and work never attended any sort of meeting

She has listed on Part 3 C I am sure she needs to do and with that she would also have to answer yes to Part 3 Processing Information question 6.

Your wife and her son share the same A#. Use the one listed on her I-130 NOA2

Other then a copy of marriage license and I-797 for approval notice of K-1 visa is there anything else from her I-485 documentation need to be added to his his?

You have to show that any previous marriages were terminated. He will also need a G-325A. Have they had their medical exams or have they had their medical results transcribed to the I-693? They will also both need to file for EAD (so the boy can apply for a social security number) and/or AP (if they plan to travel outside of the US). The boy also needs to present photocopies of his passport with the visa and I-94, photocopy of his birth certificate (translated to English if in another language) and passport size pictures.

Now a question I have with I-864 Affidavite of Support

I have marked on Part 3 box 9 and put stepson's name on 9a would I just make a copy of this and put in his application for AOS? I know he diffently not the principle immigrant,

Yes, you may just photocopy the I-864 and include it in his packet without the supporting documents.

Thanks for any help

I left the A # blank. When I received the NOA a few days later, they had assigned an A number for my Step-Daughter ...her OWN A#, she did not have one because she came in on a K-2 visa. To my knowledge one does not share an A # number. It's a unique number assigned to an individual. I think the correct thing to do is leave it blank. ... It worked for me.

Yes. 2 I-485s, one for each. Fee is $1010 for each (son over age 14) but you can write onec check. Check the son's I-94 for an "A" number. Our sons were each given an "A" number when they entered but it is not consistent. Otherwise leave it blank or enter her "A" number, they will be issued their own "A" number.

Two applications, 2 I-864s, 2 everything.

Does anyone know if this will be something we need to add to AOS packet a letter maybe or wait for interview? I am not even sure if this is really considered being involved in the party or not.

Also for her she was associated with The Communist Union of Youth, she was only required to do this because of school and work never attended any sort of meeting

She has listed on Part 3 C I am sure she needs to do and with that she would also have to answer yes to Part 3 Processing Information question 6.

Alla was a member of the Young Pioneers and Komsomol as were all students during the Soviet Union. she listed this on her I-485 and was never asked a question it.

Since she has been here, Alla now does interpretation for the USCIS, among other agencies, and provides interpretation services for AOS interviews, among other business. While she does not get to see people's forms, earlier this year she had an incident where the SAME OFFICER that interviewed her, interviewed another woman for AOS and grilled her mercilessly about being a member of the Komsomol! Alla did her best to interpret and the client was basically saying, in Russian, "tell him, we HAD to do this, it was not our choice!" Finally, Alla asked to see him outside the office and asked him whay he was making such an incident of this when "you did not ask me anything and I put it on my form...you act like you never interviewed someone from the Soviet Union." He dropped the issue and approved her AOS. Afterwards he told Alla he was concerned because the woman had said she was a Komsomol member "for 10 years" which would indicate something other than just being a student (high school and college) student member. Alla thinks the woman, now in her mid-40s simply didn;t guess the time frame right and didn't think it would matter.

Technically, Komsomol members WERE members of the communist party, however they were not voluntary members. One can take that question either way...and it would not exactly be "lying" to answer "no", nor is it a lie to answer "yes". It is simply not an easy "yes or no" answer. It would also appear, since former members of the Komsomol DO get approved for AOS, that it is not a "material" issue.

We also get together with 8 other Russian/Ukrainian/Belarussian/American couples. One of the women relates that this was a major issue for them and that her AOS was denied BY THE SAME OFIICE and her husband had to seek the assistance of Senator Leahy to get it cleared up and get her approved. The husband of another of the couples is a department director at the VSC and says that this should absulutley not be an issue...but who can control each officer? Besides, he says, they may be using it as an "excuse" while they sort out something else. Who knows?

Suffice to say, it MAY be an issue, it MAY not be an issue. It may be nothing, it may be a couple of questions, it may be a lot of questions or it may be a denial. You can look at the question and interpret to mean what you want and answer what you think to be the honest answer.

Alla had to go to Komsomol meetings and do "community service" with her Komsomol Brigade. Among other things she had to help with harvesting crops, they took the students in trucks out o the farm areas outside Donetsk...she HATED it and was always way behind the others in picking crops and always got yelled at for not doing her part. I tell her to be glad she didn;t have to dig coal and that she should be glad she didn't have to walk 3 miles to school in the snow...uphill both ways...like I did. I have photos of her in her uniform, saluting and standing in front of the Soviet flag. Except for the hammer and sickle, she looks just like a good girl scout! We did not submit any of those photos.
