I am preparing the packet right now and the one thing we are missing is tax returns, I never worked and so I was never in the tax returns, would this be a problem? I have all other evidences though except mortgage of course since the house has not been refinanced since we married and it has been in his name ever since. Same with car loan, no credit so it is under his name however, I am on the car insurance.

Use your head and have your name put everything you can during the process. Joint filing taxes is a plus even if you're not working.

You can always change the returns later.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

You can still do an amended return and do joint but that would change everything around on it. Like because I filed joint with my husband it put us in a lower tax bracket and we payed less than he would have if he filed alone.

really? even though I dont drive it? LOL

If you have a driver license you can be named as a driver on the insurance forms even if you dont drive it.

In our state we get a discount for being set as drivers on each others car even tho we dont drive each other cars.

When changing your filing status on a 1040X (Amended U.S. Individual Income Tax Return), you cannot change your filing status from joint to separate returns after the due date. You can ament the return to join after the due date. If you live in a state with income tax, make sure you check the impact the change in filing status will have on the state return.

The 1040 form requires Married filing separately to enter of spouse’s SSN and full name. Since 1040 form MUST list spouse, the reason to select joint or separate is the impact on tax liablity. However if only one of the two is working it is very rare to get the best tax liablity filing separate.
