Im unsure what I need to obtain to get this sorted. The request was as follows...

  • The household member on the petitioner/sponsor's Form I-864, Affadavit of Suuport must submit the Federal Income Tax Return submitted to the IRS for the most recent tax year

We submitted W-2 transcripts with the form. Ive searched around VJ for about an hour now and Ive seen people saying submitting W-2s just aint enough, but i dont get what they mean. What else do we need to send with them??

If the US citizen petitioner is employed, the 1040 tax return or an IRS tax transcript for 2009 should have accompanied the W2. The W2 doesn't stand by itself.

I just spoke to my wife on the phone and she said that she included the income tax return ( i didnt know ). So why would they be asking for it again??

Do you think its worth me phoning the number on the letter and asking ??

She may not have put the right one or maybe missing pages or even maybe they lost it. They need the actual papers from the IRS. If she calls them she can request them to fax her transcripts the same day or the next day.

Be happy they're only asking for one document...

It was 3 things on the RFE. One was the one i posted at the top. The second was basically we didnt send in my wifes (us citizen) birth certificate and the third was submit all supporting tax documents for petitioner for form i-864 for most recent tax year. Which is the same as the first one basically.

The phone call was a waste of time, the girl couldnt understand me, she couldnt grasp what i was telling her. Im from Liverpool and I know we have quite strong and sometimes unable to understand, accents but still, ive learnt to talk "different" to yanks coz sometimes i just get a blank look lol but in this case i was talking clear and slow.

I said, I have received a request for evidence for my adjustment of status package that I sent in August 12th. I said I have a couple of questions about the evidence that they want me to submit. She said ok. I then went on to explain that they want me to submit my sponsor's income tax return and supporting tax documentation for the most recent tax year, but that we have already sent in that information with my initial package. So i asked her if the documents where present or if they had been lost along the way AND if they are present are they the wrong documents or is there insufficient information on them because if we order tax returns and w-2s again (like we did last time) and we get the same documents we are stuck... I think its pretty straight forward, but she couldnt understand and we went back and forth for 5 minutes before i eventually gave up :angry:

edit: That list you posted is quite rediculous. I might give them another call or see if my wife can have any better joy with it when she gets home but i know she has alot of school work to do :( if only we could talk to a representative online lol

I would say send the copy of her birth cert with a full copy (every page) of her US citizen passport.

Also tax transcripts from the IRS for the last 3 years with W2s for them. (transcripts are free and they can fax them to you pretty quickly.)

Based on what you said for the RFE things that -should- do it. Also thats what my husband and I sent in with our AOS package and we got no rfe.

When you call them, ask for an Immigration Service Officer (ISO)....you've basically been dealing with a Tier1 person and they cannot help you no matter how hard you try...the ISO is a Tier2 human (I learned this from Darnell :) )

Really? They asked for copies of the the US Citizen's passport? I didn't see that on the VJ checklist or in the I-485 instructions...
