IR1 interview-Issued a blue slip 221g

Hi, I recently had my ir1 interview at the islamabad embassy and at the end of the interview, i was issued a blue slip and the CO told me that he can not issue me a visa.

So, the blue slip that i got has the section 221(g) portion checked and they have asked me to submit two divorce certificates (one from union council in urdu and another from the family court which should be in english) for my husband's previous marriage.

I had already submitted the bilingual (both english and urdu) certificate that i got from the union council, however the CO told me that it is not in the format that they require.

Now, i have spoken to a lawyer who specialises in family law and she has told me that the family courts issue a 'court order' and not a certificate, only when the divorce is initiated by the wife (khula). In our case, my husband had initiated and divorced his ex-wife and for this, as per the lawyer no court order is required.

I hope all of this is not too confusing.

What i want to know, from anyone who has been in a similar situation or is familiar with divorce laws in pakistan is that , why the embassy did not accept the divorce certificate that i had issued and how should i go about the case if no court certificate can be produced? Should i get a legal opinion from the lawyer and send it to the embassy stating that no court order is issued if the divorce is given by the husband?

I was hoping that the US embassy would be familiar with divorce formalities in pakistan and a complication like this should not have happened....

When marriage was dissolved? Get a new copy of divorce papers from union counsel, but the best way is to visit your local union counsel and discuss this issue with them I am sure they will give you solid solution, talk with them openly why you need it.

I am in a similar situation. I was married & divorced & my current wife also married before & divorced. We are now married. Their interview is is this month at ISL. I provided my divorce which is a court order from US. I provided my wife's divorce papers which are Union Council Urdu/English. This was done here when I send papers to DOS/NVC after the I-130 approval. They initially rejected my wife's divorce papers b/c they were not in the correct format. I had to get a differnt kind with translation & they accespted. I'm hoping/praying that they do not do any objections at the consulate now.

Did you submitted these papers to NVC/DOS first to have them kind of approve it?

Yup, this document was first submitted to NVC and they did not have any objections on it. Can you tell me about the new certifcate that you re-submitted for you wife?

I would suggest that you should call the embassy and confrim with them if all the documents that they have are in order. I wish i would have done that !!!:(

I translated the Urdu Union Council divorce letter in English & have it ceritifed/signed by a friend. There is a sample form which is normally acceptable by NVC. They ask that you translate the paper in English & have the form signed by anyone who certify that it is the correct translation. Then they were accepted. I hope & pray that the same is accepted at the inteview as well.

Since my husband's mode of divorce was 'talaq' family court was not involved as 'talaq' is an out of settlement. Since the embassy had asked us for a certificate from the family court, we submitted a legal opinion saying explaining that this divorce was an out of court settlement and hence no certificate from the family court is issued.

My time line is as follows:

Date of Interview: September 17th 2010

Submitted Documents to the embassy: October 20th 2010

Documents forwarded to CO at the embassy: October 22nd 2010

Visa Stamped: October 29th 2010

Passport in hand: November 1st 2010

My wife's interview was yesterday, and now we are having this very same issue. The interviewer said they need an URDU divorce certificate from Union Council even though she had the original bilingual one at the interview. So, she can get this document without a problem. Now my concern is that on the blue slip they are also requesting and English Certificate from the family court??? But the officer only mentioned the Union Council Cert. So, what should we do? Does anyone have any concrete information?

My wife's divorce was also through talaq, so do we really have to go through the hassle of approaching the family court.... this could take months.
