ok, my wife is a us citizen, i am not. we sent i-130 and i-485 packages, including affidavit of supports. my wife does not make enough money so I had to have my uncle who is a us citizen file i-864 as a joint sponsor. we sent his last years 1099 and w2 as proof also a copy of his us passport. we did the same thing for my wife. well now i got RFE stating this:

For the household member’s income to be included in the household income, the household member’s income must have been from a lawful source and earned while the household member was authorized to work in the United States.

Please submit evidence that the household member on form I864 Affidavit of Support or form I864A contract between sponsor and household member, was authorized to work in the United States. Examples include one of the following:

A copy of form I-94

A copy of a valid employment auth document

A copy of form I94 showing employment authorized

A copy of a valid form I-551 or lawful permanent resident card

A copy of a birth cert

A copy of cert of naturalization

A copy of a certificate of citizenship

I dont know what is wrong. we already sent my uncle's n wife's copies of passports and tax return papers. do you think they have maybe lost the papers or what is the problem? whose additional papers do I have to send now, wefe's or uncle's?

also the paper said we can submit a copy of sponsor's US passport, which we did when we filed the papers.

I hope your wife filled out and included I-864 as the principal sponsor. If she didn't make enough money to file taxes, write a letter to that effect.

For uncle's I-864, they're asking for his copy of naturalization certificate (he should have it) - if you already sent a copy of his passport, you can send it again, IN ADDITION to the naturalization certificate.

Don't question why they're RFE-ing you, just send them what they want.

You sent his 1099 and W2? You didn't send his complete tax return?

What address did he provide on the I-864? It sounds like they think he's living with you (they used the term "household member" several times), and that you're combining his income with your wife's to help her qualify.
