I got married in 11-24-2007,I had a valid nonimmigrant visa tel 10-19-2012,she filed I-130 in jon 2008, and she got the approval in 09-10-2008 and that file was without mentioning my Previous (married, divorce and son), I went to the embassy for an interview in 03-16-2009 and thy cancel my visa and forward the case to the USCIS and they denied the approved I-130, then she filed an appeal and they denied it, and two months ago she filed new I-130 with mentioning evry thing.

can we get approval?

and after that can I get visa?

what I shold do?

If the petition is approved then you will go for an interview and your visa will be approved or not. Don't lie or hide information on any part of the process, ever. Very bad idea.

It depends... if they charged you with missrepresentation (ie lying on the previous form), then you'll have an uphill battle and it might be best to get a lawyer.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

why did u file earlier petition without mentioning about your previous marriage, divorce and kids?

The form clearly asks for all these details?

Which indicates you were not willing to provide all the correct information you were trying to create a smoke screen infront of CO.

Even on your next application it will be difficult and you will have to tell why u were not sharing the information about your previous marriage.

I have got denial of my I-129 (Fiancee visa) at the embassy and the whole case was sent back. I did not lie anything or hide any info, but consul thought the the relationship was not valid ( I think)

We got married and filed I-130 which was approved. It was long and painful journey. You should read very interesting articles about " misrepresentation" written by Marc Ellis ( there are some links in this forum). Your situation tells me that since you did not provide all the necessary information, you got denial under misrepresentation (section).When they denied you , they probably gave you the paper of explanation why they did not give you the visa. Try to find under which section were you denied. If it is this particular section, then you will need an experienced attorney to help you to submit waivers.

You can try and file new I-130 and wait to see what will happen.
