I do not see what you are eluding to as rights, from where I sit you seem to be wandering into the realm of existentialism.

Its closer to essentialism really. The idea that all humans are born with these rights. Which actually makes since since the founding fathers borrowed heavily from John Locke.

Oh, indeed, the founding fathers were influenced by the progress being made in philosophical thinking and flirting with god given rights that did not depend on a caring deity, but none the less some omnipotent being that conferred rights on each human being at birth. However, I believe that now things have moved forward again and many thinkers are able to understand that rights are not external to human thought. If we are all born with rights, that is because humanity has agreed to confer rights upon each other based, I would contend on a simple and profound idea that we are all born free and equal. However, that is only so good as the collective agreement that this is true. Without that, rights have no meaning.
