I've got in trouble with animal control by leaving my dog in a car for a bit..I've got a ticket and had to go to the court(got charged with animal cruelty and plead quilty)....I got 30 hours of volunteer work in the animal sheltor and my case should be dissmissed in 2 years..I need to file for removing conditions on my green card(married to US citizen),need to apply for a new GC next month..My question is will having misdemeanor be a problem?Or I really need to think about getting an immigrtion lawer..Also filling for a US citizenship in April.will that affect my application?

Thanks..

I answered that very question on Yahoo answers already, but here we go again; this is a minor misdemeanor and will have no adverse bearing on your ROC case. That aside, no question in this regard is being asked (if memory serves me) on the I-751 form.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

While I am all for animal rights... I think there are just way too many wackos out there. When I was a kid we had a dog tied up (because he loved to chase our neighbor's animals) and some of the very neighbors we tried to help protect from our dog's chasing complained about him being tied up in the heat and cold.... even though he could walk into our garage while tied up. All I can say is: learn about the ppl you live around, some are reasonable and some are so insane that if they so much as see that there might maybe if taken out of context be a prob call the cops on you. Anyway back on topic... Bob is correct. :)

The form asks "Have you ever been arrested, detained, charged, indicted, fined or imprisioned for breaking or violating any law or ordinance"...........etc. Part 3 #7

It sounds like that would be a "yes" for the OP. The instructions tell you what you have to submit if you have.

Again, I think your answer to #7 is YES. You were charge and fined and given a sentence of community service because there is an ordinance against animal cruelty in your town.

Download the form instructions and read at the bottom of page 2. http://www.uscis.gov.../i-751instr.pdf

I don't think it will be a problem with your green card, but I would provide the information since it was not a traffic violation. It says even if you were not arrested. You must have some kind of court papers telling what you were charged with and how they dispensed the case.
