My fiance file petition for me. I live in the Philippines and his an American citizen. We met through a friend. We met last October 2009. He came here and spend time with me for almost two and a half months. He came back to US last January 13, 2010. Then he came back again in the Philippines last March 12, 2010. We lived together in an apartment for almost two and a half months. Then he came back in US last May 30, 2010 for his business. We so much love each other thats why we want to be together. The problem is how can I pass the interview. All the necessary document is ready, but have a little problem about his affidavit of support, about his income tax. Can you help me on what to do so that it may not affect my up coming interview. Can you give me some advice on how i can answer the question during my interview. Thanks!

My fiance file petition for me. I am schedule for interview. i have gathered all the necessary documents. The problem is regarding the affidavit of support like income tax. He declared his tax as loss. He has business and he can afford to support me. He didn't know time will come like this that he need to petition someone so he didnt expect to have problem regarding his tax. What can I do so that it will not affect my upcoming interview. How can I answer their question correctly in terms of this matter..

The interview questions won;t be a problem if you know eachother well, so talk lots, find out about his family (names and ages of siblings etc), where he went to school and such things.

What is the problem with the financial issues/ income tax?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

It depends on how much exactly he makes, and how muhc he is below the poverty line according to his taxes...

He could choose to re-file taxes, not take all exemptions, so his declared income is higher, and pay the taxes he should.

He could take a second job, maybe working at McD in the evenings or some such, for a few months until he can bring you over.

He could include his assets (savings, shares, property etc), but must have three times the shortfall.

If line 22 on his most recent (2009) tax return does not show proper income it will cause a problem with approval. There have been several VJ members in the same situation with the Manila embassy.

Let's talk about his current income, because that is what the Embassy will focus on.

How much annual income is he scheduled to make in 2010 based upon his income for the first nine months of 2010? Will his annual income for 2010 be above 125% of the poverty line for his household size? If so, you should have no problem. If not, he will need a cosponsor.

Of course, he will have to document his first nine months of 2010 income to the satisfaction of the Embassy.
