AOS for daughter of fiancee (now spouse and status adjusted)

Hello all,

I apologize for this long absence. The good news is that my fiancee had arrived in the US and we got married and now her permanent resident status has been approved.

Her 15 year old daugher had stayed back in India and her K-2 visa is going to expire on Oct. 13th 2010. Finally, we have been able to talk her into visiting the US before the 13th and get her status adjusted.

Our questions are:

1. Would she be interviewed by USCIS or would they adjust her status based on her mothers approved (permanent resident) status?

2. Would her fingerprinting process move any quicker than her mother's?

3. She is willing to visit only for a month or so - is it possible to get her status adjusted within a month given that her mom's status is approved?

Any other thoughts?

You will need to file the same way you filed the AOS the first time but for the daughter this time, full AOS package with payment etc. It wont be done in 1-2 months.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

This is correct.

In addition, you probably shouldn't be applying to get her a green card if she only intends to visit. Green cards are for permanent residents, and permanent residents are required to actually reside in the US. If she's not ready to live in the US then she should come as a visitor. If you got married before she was 18 then you can sponsor her for an immigrant visa when she's ready to come to the US permanently.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Jim and Inky,

Thanks for the response. We were hoping, since she has her K-2 and medical etc. all done, that visiting US and adjusting status could save us all the hassle of refiling for her again. We still hope that when she is past this teenage phase, she might actually change her mind or visiting here may make her think again. We can only hope................
