I am a US Citizen wife sponsoring my husband who is here on an H1-B visa.

Our AOS interview was inconclusive. At the end of the interview, our DAO stated that we will "receive a decision within 120 days" without explicitly stating whether we were approved or denied.

The following is a non-chronological summary of our interview to the best of our memories:

-Verbally verified information on our I-130 forms (ssn, names, address, date of marriage, any previous marriages, any children, name of employer etc).

-I handed my supplementary evidence folder . She did not even open the folder, commented on the overzealousness of my preparation of that folder, and placed it aside.

-She asked my husband the standard morality questions on the I-485 petition

-She took away the I-94's.

-She could not find our original marriage certificate AND my original birth certificate in her file. We presented our original copies and she made copies..

-The only personal marriage questions were the following:

1. How is married life is treating us?

2. How long had we known each other?

3. Describe the course of your relationship. (very open ended and invited both of us to discuss jointly)

4. What happens in an arranged marriage?

5. What are your plans for kids?

6. How is married life? (second time no joke)

7. Did both of your families live in North Carolina?

We were in her office for approximately half an hour. Overall, her personality was very calm and casual. She engaged in conversation with us (how she was getting married soon, how she used to commute from Silver Spring but moved to the Baltimore suburbs, how she takes the MARC train, how she has a friend where we honeymooned).

However, our concern is not only receiving a decision on the spot; she did not look at, inquire, or discussed ANY of our evidence other than photos. She asked us NOTHING related our I-864 (nothing about current paystubs, proof of updated employment, etc). She did not take away the EAD or Advance Parole Document. We called the 1-800 number inquiring about the status of our application and they told us to check back after 30 days with an InfoPass request.

Should we be concerned about this case being further reviewed or our being called in for a Stokes interview? Is it just that she is fairly new and has to obtain approval from her supervisor? Or possibly our background checks were not completed in time for the interview? If any of the above is not a concern, is there the potential that our case will be backlogged and that we will not hear from them within the 120 days?

** moved from "Adjustment of Status (Green Card) from Family Based Visas" to "Adjustment of Status from Work, Student, & Tourist Visas" as you are adjusting from a H1B visa and the prior forum is for K1, K2, K3 & K4 **

I would say don't worry. Overall, your interview went very well. A lot of VJ members didn't receive a decision on the spot and they got the approval email or txt within a week or so. Baltimore office doesn't play games, they work pretty fast so I am sure you will get a decision very soon!Good luck!
