hello everyone..

i am planning to apply for citizenship but my divorce is'nt final yet

i got my GC since 2006..and i wonder if i should wait for divorce to be final to apply..

or should i apply now?

should i put in the forms that " married but divorce is not final"

Hi!

1- Are u applying on based of marriage? 3 years rules. ? Married from American Women/Man?

2- Are u applying on based of 5 Years rules?

well seems u are applying on 3 Years rules. well if u apply now maybe ur divorce final will come the day before ur interview. (WHO KNOWS) that means ur applcation will be denied. and u will be forced to follow the 5 Years rules. well it seems u got ur green card in 2006 that means next year u will be eligible to apply on ur own. so dont give a chance and save ur money. next year not far to come.

hello everyone..

how long have you been a LPR? month and date, it depends on if you qualify to file the N400 or if you have to wait a little longer. 90 days before your 5 year you can qualify.

That is Correct.

$675 ($595 plus a biometrics fee of $80). Applicants 75 years of age or older are not charged a biometric fee; their fee total is $595. No fee is required for military applicants filing under Section 328 and 329 of the INA.

About u aleful, when did u get ur green card! and what type of green card u have the 10 years 1 or the 2 years one? and are u filing for divorce, i mean is the divorce in proccess?

and if u filing on a based of marriage of a U.S citizen, does she/he has her Citizenship for at least 3 Years?

In your case since your divorce is on the process, I would recommend to wait after 5yrs before filing your US citizenship. I believe that filing after 3yrs ONLY applies if you are still legally married with your USC spouse. One of the requirement of filing after being 3yrs is the proof that you still live in one roof and still legally married. If you file after 5yrs, you don't have to submit any proof of relationship with your USC spouse but you are applying on your own which you only have to proof that you have been a legal resident and physically present here, and you meet the requirements to apply for USC.

i got my greencard thru marriage..march 2006 is when i get my LPR..

i want to file for my own....

if its best to file after my divorce then thats what im going

to do..

is there any requiremnts that i should submit besides the photos?

my case was different. I applied by the 5 year rule since my USC mome filed for me, so I became a LPR through my mom and I already came to the US divorced.

but LHi is correct. To apply by the 3 year rule you still have to be married, living at the same address, under the same room and provide proof more or less like when you became a LPR. taxes together and all. utilitie, the whole thing.

that's not possible since you are going through the divorce. I also asked you about the exact date that you have been a LPR, 90 days before your 5 year you can apply, and by that time you'll have your final divorce decree.

I submited a copy of my divorce decree with the N400 since I marked that I was divorced

If you became an LPR since March 2006 then you only have few months to wait to be eligible for the 5yrs rule citizenship application. You only have less than 5 months waiting time be qualified:dance: :dance: :dance: Just hang in there!

There isn't that much requirement that you have to submit for the 5yrs citizenship application compared to 3yrs rule application. Just proof of you being physically presenf here and haven't been out of the country for more than 6 months, income tax, GC, Birth Certificate, passport, etc....
