Hi..guys & folks. I have little confusion so i want to know the reason from everybody. I see many people are doing IR1/CR1 from USA rather than doing DCF in their home country.As we know that DCF(Direct Consular Filling) is the fastest way ,then why u guys are went/going through the USCIS process?? :o

Sorry abt the question,but for information i want to know. Is there any reason ?? Or personal reason?? or what?? PLZ everybody post their answers here.

Hi

There are a lot of reasons.

Firstly, DFC is not available in many consular office. It doesn't exist in a lot of countries.

Then, not allways are allowed to file it, in most consular offices, you need to be a legal resident of this country for a period of time before to file it.

And it could be so expensive and if the USC live in USA it is cheaper thatn move to another place.

But if this is not the case, DFC is the best option for people that live overseas legally and your CO allow this process.

There is a 6-month residency requirement for the US Spouse to fulfill before they can qualify under the DCF process; this is hard to achieve is the US spouse is employed in the US full time or operates a US business full time. Not everyone qualifies for DCF.

02-23-2018: Sent N-400 Application online

02-23-2018: Date on NOA, retrieved from online account

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

USC must live in the foreign country for 6 months to be eligible for DCF. While we love our spouses very much, we aren't going to sacrifice 6 months of our lives in a foreign land--many with lots of mosquitoes and other icky things.

For me, personally, I DID NOT wish to live in China for 9 to 11 months.

I could have done it, it's easy for me (no financial restraints) but I absolutely not want to do it. I've done it before, see, and once is enough.

For us, it wasn't an issue of 'speed' or 'come to USA fast' - so 'going DCF' wasn't an option we looked at. Instead, we looked at the 'get an IR-1', instead, and I'm in China with her, 6 months out of the year, already...

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

In India (and in most other countries as well), the USC petitioner must be the resident of the country for at least 6 months to qualify for DCF filing.

Here in the USCIS, most people get their I-130 approval in less than 6 months time.

The good part in DCF is you can have with your spouse. Also, if you are already resident, this is the express method as well.

DCF also has the added complexity in the financial part of the process.

You must still do the Affidavit of Support and prove financial ability to support the beneficiary.

But since you are in the foreign country you may have to prove to them intent that the Petitioner has reason to move back to the USA. This is an added level of complexity, additional proofs, documents, etc that is not present in the regular CR-1 visa petition process.

Yes. I wanted to add this point, but Bobby did it. Some petitioner will have better income in the foreign country and they are fine. If not, they will need to find out co-sponsor to execute the affidavit of support.

So i dont think so there is any complexity in DCF.Its nice smooth and quick process.

Yes, 3 months stay over there wouldn't damage the Affidavit of Support as well for many of them.

Where were you when i started this process! I totally would have done the DCF route if i had known.

Problem is there isnt enough information out there for us indians on this topic. Everyone kept giving me different advice at the time so i was too scared to stay in India for 3 months just to get denied at the end.

Speaking of which, i recall that happening to someone here. Let me search for that thread...

Hi Loto , thats why i was confused about that why people frm India are not doing DCF??? Even if it is the fastest process.

Lets see below example:

If USC coming here for marriage in india,then suppose he/she will come atleast 3-4 weeks prior to marriiage. Then suppose 3 weeks will take in marriage and the next process of family events.After that suppose u guys gone for Honymonn 1-2 weeks.And after that 2 weeks it will take to collect all docs,like marriage certi and all.

If we count now then the USC has completed almost 10 weeks for all above events.Now USC has to spend only 2 weeks more for his/her sweetheart.And thus USC will complere 12 weeks,means USC has now completed 3 months.Now for the DCF the 3 month recidency period will be counted from USC's arrival date in India.So now USC and his/her spouse can go for DCF in New Delhi.

Suppose u have successfully done DCF,then now within 1 week USC can go back to USA and start the preparation for Affidavit of support,Bank letter and Job letter. Now the Spouse of USC has to live without her/him only for around 3 months.

So guys,is it not so nice?? Is it not so quick???

@Loto : Yar..i cant believe that u dont abt this DCF and the 3 months requirement as ur active member(like as admin),of VJ.
