6 Months til we get married-K1?

Isnt an AOS alot faster and allows you to work and reside in the USA from the date of your marriage?

Reside? Yes.

Work? No.

To Work, you MUST have EAD in hand, at a minimum, when doing AOS.

But to be blunt -

Filing AOS doesn't get you any 'blessing' on anything.

RECEIVING A GREEN CARD gives you status.

Inbetween filing and receiving? Yer in limbo on many things, especially work. If you leave USA whilst AOS is processing, you might be 'viewed' as abandoning yer AOS application.

Could she move to Canada, live with you after marriage, instead? If the goal is to 'be together', then you might have the same amount of time, from start to finish (including 6 month residency requirement on HER) by filing a DCF'd I-130 6 months after her 'residency' date - but she'll need to get some 'Canadian Residency Permit' - which I understand to be dead easy when married to a Canadien.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Ok so say we get married in San Diego in March 2011. I have to then file for an I-130, wait a long time, then wait for an interview in Montreal. Isnt an AOS alot faster and allows you to work and reside in the USA from the date of your marriage?

um if i understand correctly you want to move to america, get married in march then file aos ? thats intent to immigrate thats fraud.

We are still waiting on our NOA2. Once he gets here we are going to the justice of peace to get married and then start the I130 & I485 process... 90 days is not enough time to plan a wedding so we are having a formal wedding at a later time with friends / family. Hope this helps.

A friend of mine had a full wedding for her small family and friends and planned it while doing the K-1 visa, it is doable. It took her a lot of work tho, her wedding was really nice she has great pictures.

Our wedding is already planned and so unfortunately that isnt an option for us.

What happens if we file the K1 and have not received it and go through with our wedding? Can we file a Marriage Visa after that?

Hello!

If you are planning to file for the I 129 F, fiance(e) visa, it means that you would have to wait around 6 months (for some lucky people the wait is less, for some the wait is longer) to get the K1 visa. If you marry before getting approved for the K1 visa, then you will have wasted your $455 petition fee and you will have to file different paperwork (with separate filing fee) and wait, though this time it would probably take longer (historically fiance(e) visas take less time than K3 or CR1 visas). You would do well by carefully reading the guides available in this site and the comparison charts between K1 and K3 visas. There have also been previous posts that discuss the advantages and disadvantages of each visa option. I can only wish you good luck, but it seems to me that having planned the wedding without having had the visa approval was akin to counting your baby chickens before they hatched... It may not work out!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Ok thanks. Its becoming more clear. Ive been navigating this site on my time off for months but was unsure which route to take. We are in the Air Show industry where we will need to do most of our business in the USA.

I dont remember saying that? I believe you have misunderstood. I deal with US Customs on a daily basis for my job.

Do you mean that your friend had the party or ceremony aspect of the wedding, but not the LEGAL aspect of actually getting married? You know, you can't get legally married to your fiance(e) while waiting for the K1 visa approval without forfeiting the in-process petition...

you did not read the other persons post that i was commenting on please go back and read their post. she got her k-1 and came to america and had a full wedding reception cerimony legal marriage. THe other person said you cannot plan a wedding in 90 days and my friend did. That is what i was commenting on.

I don't think that's what they meant at all. They simply said that their friend planned a full wedding (instead of just a visit to the justice of the peace) while dealing with the uncertainty of the K1 Visa process.

Gap 1 - once you're out of the CSC blackhole you should breeze through. I'd say April is realistic but you might cut it close for getting to the USA.

I hope he's living here by April! The wedding aside, I'll go mental if I have to live another 6 months like this. We were hoping he'd be here by March at the latest (pending any visa issues).

This isnt true because montreal is a black hole lately. They even have a DOS team there to fix the issue with a bunch of peoples visas that were told they printed but were never printed.

Just have everything (vendors) able to push everything forward if necessary...that's what we did, planned the wedding a year in advance. Worked out well for us :) but like others have said, the Montreal consulate is backlogged :(
