6 Months til we get married-K1?

Hello,

My Fiance is American and we plan on living in San Diego (her town).

I am Canadian.

My question is if we are getting married March 18 2011...Do we have enough time to file the K1 and Affidavit of support from my future mother in law before the wedding?

We would like to be living in her town by the time the wedding happens.

I'd definitely plan a later date. We filed nearly three months ago and haven't heard anything and our wedding is planned (loosely) for April. I'm starting to wonder if even that's too early for us.

The k1 process for some are as short as a few months and for others 6month + .. if i were you and still wanted to place a k1 petition i would make the wedding at a later date

Thanks for the reply.

Our wedding is already planned and so unfortunately that isnt an option for us.

What happens if we file the K1 and have not received it and go through with our wedding? Can we file a Marriage Visa after that?

If you are NOT Interviewing in Montreal, then I'd suggest to you that you have a shot at making that date.

IF you are 'homed' to Montreal, though - NO WAY !!! Montreal is lagged, is deep black hole, slimey pit of despair.

yep then you are bound for a montreal interview, and montreal is pretty backed up lately! I dont think it would be very iffy to make it through there in 6 months, specially with all the new system stuff they are starting now.

Moyo, your planning is backwards for K-1--for that you should plan your wedding AFTER you know the date of your K-1 interview.

Moyo, your planning is backwards for K-1--for that you should plan your wedding AFTER you know the date of your K-1 interview.

There's nothing wrong with planning a wedding in advance, as long as nothing's set in stone. I'm already thinking of what I'd like for my wedding, even though it's months and months away and I don't have a date yet.

Yeah we're just having a civil ceremony, so while we're reserving a judge it can be easily rescheduled if necessary (hopefully not). I'm going to look into booking a party room at a restaurant, and most have 30 day cancelation refund policies if something bad happens.

I can't imagine how difficult it would be to plan a big traditional wedding in this circumstance though. At the rate the CSC has been moving I fear an April marriage might have been too ambitious for us, and we filed at the end of June (I naively assumed allowing 9 months for the process to work was plenty of time). Not to mention the holidays are coming up where the average office has a million people out on vacation and business days are lacking. I'm not hopeful at this point.

We were supposed to live in Canada as my company was to be based here. Our wedding was planned in San Diego for her family. Now we are moving down there after the weddding but it appears the K1 process has slowed down.

I was looking into the I-130 also. Im not really sure about how that works. With me being Canadian (but not having the legal right to work in the USA) what are the requirements? Can I file for an adjustment of status when we get married or do I have to be under a work visa already?

I-130 you have to be married, you go to an interview in canada get the visa when you pass then move to the USA. You will get the green card in the mail a few weeks later and then can work. You dont need to AOS if you file CR-1.

I-130 you have to be married, you go to an interview in canada get the visa when you pass then move to the USA. You will get the green card in the mail a few weeks later and then can work. You dont need to AOS if you file CR-1.

Ok so say we get married in San Diego in March 2011. I have to then file for an I-130, wait a long time, then wait for an interview in Montreal. Isnt an AOS alot faster and allows you to work and reside in the USA from the date of your marriage?
