I130-Approved when beneficiary is now in the US...What to do next

Hello every body,

I received I-797 informed me that my I-130 petition for my younger sister was approved and the visa petition was sent to NVC...

However, my younger sister is currently in the US under the F1 student visa.

Besides, my mom was also received another notice of approval for the I-130 she filed for my little sister.

Would someone please advise what I should do next? Can my younger sister file the form I-485 to adjust her status when she is here?

Your sister is in the usa on F-1 Status so assuming that she is in "legal" status then all will smooth easily. You WILL need to contact the NVC at 1 603 334 0700 and let them know the applicant (your sister) is not overseas BUT in the USA. At this time they will forward the case BACK to USCIS who handles the Adjustment of Status.

You might can contact USCIS now if the case has not been forwarded to NVC and let them know of this so the necessary forms/fees can now be submitted them. 1800 375 5283.

July 19 2013 - Enter the USA
