Waiting for the ref letter. My lawyer told me that sometimes they do this to buy themselves more time because its so close to the 5 month mark because we looked up our application and had above and beyond what you needed, every box checked, etc. She says she's gotten ref's for clients because the CSC has lost stuff in the wait period.

Nope i am still waiting for request for evidence. I have talked to tier 2 person he was saying that i will receive RFE hard copy this weekend. Only the Hard copy can tell what is requested so we need to wait a bit more... hope to get it soon

Heyy frnd dnt mind my words but lawyers just sucks untill u find a gud one. There is no rocket science in petition only three poitns are mandatory for approval which if u fulfill u will get NOA2. There is a continous non compliance of 5 months mark since june 2010 coz csc is extremely overloaded most of us are getting RFE after 5 months u are lucky to get it after 4 months. If ur petition is lacking anythng which is mandatory for the verification of these three poitns u will surely get RFE it is not the matter of extending time that CSC giving RFE trust me. Lawyers remove burden of proof from thier shoulders by saying these kind of stuff coz they have many petitioners in pipe line. what u can do is to bug uscis as well as ur lawyer and submit ur RFE response fast u will get NOA2 soon. God bless u

, i have copy of my application and all the pages and we aren't missing anything, I've triple checked my copies against whats required, i can review everything the lawyer did and see that we are in every requirement of our application. CSC had to have lost something if its not in there, that is why we are so puzzled that our application got an RFE. We still don't have our RFE letter so we have no idea what they are requesting but we put more than what they were asking for because we've been in a legitimate relationship for 2 plus years and included above and beyond what we even needed.

:ranting: I know I'm ranting because you guys have them too. It's just not easy no matter how much time you've waited. I see how everyone is going through this process and it pains me that we are all having to go through this. I wrote my senator about it and in fact will be writing a book about it ( hopefully to help!)

What are the three points?

What are the three points?

1. petioner must be a US citizen.

2. Rlationship should be bonafide.

3. Both are free to marry and intend to do so within 90 days of benificiary's arrival to US.

These three points are verified thorugh a number of diffrent ways. Point 1 US citizen. They check birth certificate, us passport, certificate from department of health or any thng which can prove that u r US citizen. if u lack anythng they ask for RFE. RFE might be anythng u forgot to check anybox or or didnt fill up any field or u didnt submit anythng can turn into RFE. when u get RFE u will know what ther want. Dnt worry man keep fingers crossed i understand this time killing is very hard but we cant do anytnhg except to wait for RFE hardcopy.

You missed an important requirement - petitioner and beneficiary must have met within the last two years, and you must have primary evidence of this.

1. I am a us citizen , submitted birth certificate, all pages of my passport etc. 2. Relationship has a ton of proof. we've been together for 2 years, in fact we've even lived together, we submitted our lease, have tons of plane tickets back and forth , pictures of friends coming to visit us in our new home. 3. Both never been married and will marry once he gets here. So we know its gotta be something small like somehow a box missed even though we've reviewed it several times to check. Maybe thats why I'm so puzzled and surprised but alas all we can do it wait for the hardcopy:wacko:

I did call and they were no help - they guy basically read me the email they sent and when i had questions he repeated that he wouldn't tell me anything until I've received the letter and to only call if its been 15 days and we haven't gotten it yet. Hopefully we get it today

Let me know once you get your letter- hopefully its something easily fixable and we can all move on with our lives

Please let us know when the letter arrives. I'm almost as curious as you are (ok, maybe not)...but I'm wondering where our RFE is :hehe: ...or approval...I think I would rather be in your shoes right now - anticipating the word on the RFE - rather than waiting for God knows how long. It sounds to me like you have all your ducks in a row and will move past this swiftly. Still curious to know what USCIS could possibly want from you. Were you previously married and divorced?

I am sending out my request to congressman and senators today. I already have the forms filled out, my letters written, envelopes stuffed, stamped and hanging on the mailbox.
