Hello all,

My husband is the US citizen and wants to bring his family (brothers, sister, mother) over from Honduras. I have beee on the USCIS site as well as the guides on this forum and the processing times say 5 months. Yet, when I read forums etc. I hear people have been waiting since 2001!??? Which leads me SUPER confused!! I know last year or so when I checked it was like 8 years...but then all of the sudden I checked a few months ago and it had changed to 5 months.

What is the straight answer??? 5 month wait or 8-10 yrs???

September 11th, 2004 - Met in Asia

May 2007 - Engaged in Hawaii!!

June 2008 - I-129F Petition

June (I think) 2008 - NOA1

October 2008 - NOA2 (P3 sent to wrong consulate by accident)

December 2008 - NON-legal wedding ceremony in Honduras

January 19th, 2009 - P3 finally arrives to correct consulate AND me!!

January 19th, 2009 - "Overnighted" P3 back same day. I am so efficient!!

January 23rd, 2009 - Montreal finally gets it. "Overnight" my a**!! Money refunded to me from Canada Post...ASAH!

March 27th, 2009 - Notified by phone call of interview date

March 31, 2009 - Interview Letter received in mail (P4)

April 6th, 2009 - Medical

April 17th, 2009 - Interview!!!

April 27th 2009 MOVED POE - Buffalo Peace Bridge

May 1st 2009 - Married!!

May 18th - SSN arrived in mail

May 14th, 2009 - Filed for AoS - Come on NOOOO RFE'S!!!

May 22nd, 2009 - NOA1 for AoS, AP, EAD - California Service Center. ASAH

May 30th, 2009 - Biometrics appointment letter received for I485, I765 (where is the I131????)....date June 12th. 2009

June 2nd, 2009 - Biometrics completed

June 15th, 2009 - EAD Card production ordered!!

June 20th, 2009 - AP, EAD arrives in mail! (no email from CRIS)

July 2nd, 2009 - AOS Transferred to California

August 7th, 2009 - Green Card production ordered. WoohoO!

well it might not be 5 months (are you looking at only the I-130 USCIS time frame? add time for NVC, embassy interview) but the shorter time will apply for his mother. siblings i'm sorry to say is the several years time frame.

UNLESS, they are minors who would be coming over with his mother....

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.

Well I guess I mean 5 monthsISH.....assuming the other parts of the process do not take 8 yrs ;)

Well his siblings are adults....so....I guess it is the 8 years then huh??? Parents are short(ish) and siblings are longer (8 yrs or so). But why on USCIS does it have (specifically stating siblings), 5 months??? Its a bit deceiving, no?

the first form, the i130 can take from 5 months to several years depending on who is he filing for.

parents are immediate relatives so they don't have to wait years.

siblings are a different story. the approval can take years, sometimes months, but the time of the approval doesn't matter that much. once the i130 is approved, it will be sent to the NVC, national visa center, where it will be filed until the priority date becomes current.

that's why it takes so long. it takes more than 9 years for siblings, as you mentioned they are working on cases filed in October, 2001

as you see ther is a looooooooooooong period of waiting between the approved i130 and when the second part starts in order to go through consular processing.

If his siblings are unmarried, he can file for his mother and when she becomes a LPR she can file for them. how old are they? It might lower a year or two of waiting.

for a brothers petition it takes about 10 to 15 years. The USICS are just now approving applications from 01 DEC 01. But for parents the process its a lit faster. I believe is about 2 to 4 years and brother that are under age would be able to fly with them. Also, Make sure that when he fills out the petiton for a bother that has a family to include them in the application. Otherwise, they would have to do a different process which it would be more time and money.

Ok I think I get it. The I-130 takes 5 months but then when it is sent to the NVC THAT is what takes so long??

You mentioned number priority date? WHat exactly is that??

To be honest, I am not surprised - when we looked into it before I DID see 2001 and was baffled at the idea of 5 months................we can all hope tho huh? ;)

His siblings are adults - mid 30's.

JUst out of curiosity - IF his siblings decide to file - one of them has a Honduran wife and 3 children under the age of 15. What happens in that case? Does he have to come here first and THEN deal with USCIS again and file for them to get them over???

Man now I know why there are so many illegals in this country - who wants to go through this!? (FYI I am totally legally here from Canada ;)

not true, siblings aren't derivatives. it doesn't matter how old they are, a USC has to file separate petitions for siblings. they cannot come under their mother.

i'm not sure if they are very young like babies or very young children.

but usually the sibling is only information.

the F4 sibling category is for all siblings, under 21, over 21, married or unmarried. there is only one category for siblings.

yes, they have to file petitions but i believe they are dependents of the mother if they were minors and not 30+yo like in this case.

same with the sibling with a family... once they become eligible the wife and child/ren would be dependents.

USCIS is the first step, then NVC, then embassy

from those timelines one USCIS website, it looks like USCIS can also take years if it is not the spouse/child.

for the immigration process you need to read read read and then read some more. each case is different, depending on what country you're in, which visa, and so on. go thru the guides and bookmark to be able to find later so you can refresh your memory on things. sign up for updates on the USCIS site so when they change forms/rules that apply to you and yours then you will know right away.

I know I have to read read read....I thought I was done with USCIS! I guess I was just trying to find a quick answer (tho I did spend a fair time reading) to give my husband's relatives so they can decide whether or not to proceed. 10 yrs versus 5 months is QUITE a difference.
