the I-751 filing dates, 90 days period

Hello, everyone:

I've been in this forum for a while, and posted twice, including this time:)

I have a question regarding the I-751 filing dates, in my case

my 2 years card was issued on August 26th 2005,

so I'm going to submit my I-751 on May 26th 2007, which is the first day of my "90 days" period.

I read some good luck fellows had their I-751 approved in 2 or 3 months, I was wondering does this "2 or 3 months" including the 90 days period or not?

In my case, if I submit my I-751 by May 26th 2007, does that mean if I'm luck enough, my application will be approved around August 2007? or even if I sumbit all my paper work the first day of "90 days", I still have to wait until August, then my I-751 will be reviewed?

will my I-751 be reviewed as soon as I submit it or has to wait until the 90 days passed.

Long time, indeed!

First of all, please use the date calculator mdyoung gave you to find the CORRECT date to file your petition.

It is very unlikely that your I-751 will be reviewed immediately or even within that first 90 days, but there is NO WAY to tell. When the Service Centers devote some time to I-751s, they will suddenly speed up. Then they go to work on something else and I-751s slow down again.

You should expect that it will take 3-18 months for your I-751 to be adjudicated. Your status does NOT expire during this time; yoiu must keep your expired card with the extension letter you recieve and just wait. There is no way to track your individual case online or over the phone, so you just mail it and wait.

People are receiveing different instructions and there is no way to know which ones will apply to you. Watch your mailbox and respond to ANY letter you get from USCIS and follow their instructions. It's not rocket surgery, but you have to follow their directions.

If a year goes by and you want to apply for US citizenship, you may do so even if you do not yet have a decision on your I-751.

But please, mail it in the correct dates---if you send it in too early you have just thrown away $205 that could go to charity. :)

I have another question, its regarding the credit card statement.

I added my husband's name under my account, so he also got a card as an authorized card holder, but his name doesnt showed on the monthly statement, so I was wondering except the credit card itself, what other evidence regarding this we can show to the immigrant office.

(PS: if anyone here remember me, probably know the reason that I can not have a sharing account with my husband, thus, credit card is probably the only financial prove I can show)

HI! My I-751 was delivered to the INS 2 days earlier then its supposed to be as we have filed it earlier then 90 days and NOA was dated 2 days earlier as when the I-751 was received. Anyways,everything went pretty fine :star:

HI! What about the bank account statements on both names?...

If you have one like that it woudlnt hurt.

Actually in my case, its kind of complicated, I used to have a sharing account with my husband, and he abused it by deposit a fraud check in and took away 3000 cash from the bank, even now it is still negative balance on the account.

and recently, the detective just called me regarding this case, my husband may be physically arrested if he doesnt return the money to the bank. (I was also finacially involved due to my name is also on the account, but the main reason police came to us is due to the fraud check)

I really hope we will be fine since at that time when we got married, he was a fine person. It feels so hurting to look back...

I was wondering

1. he is unemployed right now, will this affect the I-751 application?

2. if he is physically arrested, whats going to happen to me?

Tomjerry, you sound like a very nice and caring person, but I'm going to give you some straight advice.

Not only should you stop worrying about this individual's Permanent Green Card, you should divorce him immediately. He shows absolutely no respect for you, and gets you involved in a fraudualent situation without an apparent care. (And here you are on this board worrying about him.) I encourage you to check your credit report. He may have gotten credit cards that you don't know about.

He may have been a "fine person" at one time, but in my life experience, fine people don't steal $3000, show a total disrespect and disregard for the process, and involve their spouse in criminal activities. (yes, you are responsible for that account because your name is on it too) And the thing is, you can't take your name off of that account until it gets out of the negative.

If he does get arrested, my guess is that he can kiss his Green Card good-bye because one of the questions they ask on it is "have you been arrested?". He can always lie though, which he appears to not have an issue with.

The least of your worries is when the 90 day period begins.

Why do people feel the need to use this expression? There are no immigration red flags that I can see, of course, that doesn't mean that there might not be cause to look into a spouse's activity and determine if there are underlying activities that might be cause for concern in the marriage.

He is not the immigrant, once again, and admitting that one has been arrested does not automatically result in a revocation of a green card.

Sorry TomJerry. I missed the part where you were the immigrant in question, therefore most of what I said doesn't apply, so you should stay married by all means to get the Permanent Residence Card. I admit I skimmed parts of your posts and usually in a situation like you described being posted on this board, it's the citizen that is complaining about how they are being fleeced.

As for the Mermaid who took the time to pick apart every line of my post using the same point that "the OP is the immigrant", you only had to say it once. I get it.
