hi again, sorry to keep on posting questions here at vj but i guess it will help others too. the more question the better (lol) for others. ok my question is my guardian will go with us on way to Seattle washington to attend my wedding ceremony on October since both of my parents are not living anymore i want my guardian to be present on the ceremony in replace to my parents. but the problem is her tourist visa will expire on November this year and if we arrives in washington by Sept 24 and if granted to issue a 6months of stay does it matter or have any problem when she leaves after 6months in seattle ?since the visa is expired already and does it be a big deal to immigration/US embassy to renew her visa of overstaying? if ever she likes to renew her visa again when she comes back to the Philippines in order for her to come back again at state or she needs to renew her visa right away even if its not expired yet b4 we leave .Pls advice what to do thank u and godbless again

As you mentioned, your wedding is on OCtober and her Visa expires in November. As long as she leaves the day before her visa expires, I dnt think there would be a problem. Yes. If she overstays then that could be a problem later.

u mean she needs to leave US soon as it expire or b4 its expiration? whats the purpose of issuing a 6mos. of stay at the POE then u mean this is useless ? shes a senior citizen maybe they wont consider that my guardian is just doing such illegal thing there and spend the whole 6mos even its expired already does it really considered as overstaying, what do u think? thank u

Why are you thinking that she will be approved for a 6 month stay if her visa expires prior to that?

i am just assuming if it happens and gave consideration but not exactly i know she will be granted to stay a 6mos of stay i just heard someone was given a 6mos of stay even her visa was about to expire on 3mos time

Just like the rest of the visa extention, you have to apply 3months prior to give you enough time before the visa expires. Did you/she already submit the application? Maybe you can give them a call about your guardians status and see if she could stay here until her 6 mos. extension gets approved. I have a cousin that submitted her application for AOS few months after her 2yr conditional GC expired and she still got approved for 10 yr GC. I know its a different case but if your guardians extionsion of stay is already in process, she might be able to stay until the result came. Your best option is to call your local USCIS or make an info pass.

Did you sponsor your guardian coming here? If you do, you might need to be careful because if she overstays and become an illegal immigrant then it could hurt your US citizenship process later. Anyway. I hope everything goes well and hopefully her visa gets extended! Goodluck....
