Hey everyone...I am from Romania and me and my boyfriend wanna spend some time together in US, we really love each other but we wanna see if we can live together before we make any life changing decisions as getting married.

My question is: what if after 1 or 2 months living together we do decide to get married?..can we do it while I'm there on my tourist visa? and if not why not? and what else could I do?

Yes - you can marry on tourist visa, but after you are married you will have to return back to your home country, in meanwhile your bf will have to file for your CR1 process.

Once the process is finished your can return back to US.

Some ppl will tell you yes get married and then do AOS - which is illegal and considered as VISA fraud so you might want to stay away from that.

You never know when any of the VISA violation will come and bite you.

Yes you can get married while you are there on a tourist visa, however if you intend on marrying you will have to return to your country when filing the cr-1 visa. If you did not intend on being married then you could possibly do "adjustment of status". My advice would be to have a visit and then begin the k-1 fiancee visa, this would give you 90 days once approved to live together and get married. Or the cr-1 visa which once again you can visit, get married and return to your country after your visit to start the process.

Yes, you can. The guides you need are here. I am running on the assumption that you are in the US right now; you can't enter the US on a tourist visa intending to immigrate, because that would be visa fraud. If you entered just planning on spending some time with your boyfriend, then spontaneously decide to get married and stay, use the guides to adjust your status from tourist to landed permanent resident.

Do not leave the US once you have filed your AOS papers until you have either your Advance Parole (AP) or your green card, it has been taking 3-4 months lately. Also, to be on the safe side, wait at least 2 months from your arrival before getting married, it looks better from an 'intent' point of view.

AOS based on marriage is not illegal, or it would not be an option.

I did not mean just the AOS, I meant the whole thing of entering with intention to get married while on tourist visa is Fraud.

I hope this makes it clear.

Just to clarify, and I know this is what you meant - entering with intention of immigrating while on a tourist visa is Fraud. Intention to get married is fine.

Yes and thats wht I said in earlier part of my orig post, one can get married no issues, but then return back to home country and finish rest of the immigration process from there.

Now you can also say why not do AOS and it might even get approved too....lol then where does the fraud comein ??? lol

If you dnt have a tourist visa, I wouldnt count on getting one. It would be very dificult for a young single woman from Romania to qualify, and more so if they knew you were coming here to visit your boyfriend and possibly get married. You should just do the K-1 visa after you decide whether you want to get married.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

AOS is adjustment of status, and you can't intend to follow that option at point of entry on a tourist visa. Basically, if you came in intending only to visit - so, you still have ties like a lease, a job, etc. to your home - and then suddenly decided to get married, you could simply file for AOS after your marriage and stay in the US once approved. The important thing is to not have intent when you enter the US, since it is visa fraud to intend to immigrate while using a non-immigrant visa.

Check out the AOS from a work, student, and tourist visa forum if you are curious. However, I must stress - it is illegal to PLAN to immigrate to the US on a tourist visa.

No, I'm not in the US right now... live in London..but we plan for me to go there probably next year...or maybe this one, not sure yet..
