NOT getting the interview date or EAD

Hi

I am a Pakistani citizen. I was living in the UK since 2001. I got married in December 2007 to a US citizen - applied K3 in the second quarter of 2009 -

K3 visa approved on 4th December 2009 (in US Embassy Islamabad) - K3 visa picked up from the US embassy Islamabad in April 2010 (because i was in the UK so i did not get a chance to send my passport to the US Embassy Islamabad to get the sticker on my passport any way got the sticker in April 2010) -

Arrived in the US as a K3 Visa holder on 1st June 2010

Applied Adjustment of status I-485 and EAD I-765 on 24th June 2010.

Biometrics done on 28th July 2010

Now the problem is that since my biometrics, I have not heard any thing from USCIS. it is been (almost) 7 weeks now - NO INTERVIEW DATE and NO EAD Letter - My cases are not even being TOUCHED online. they are stuck on INITIAL REVIEW - Only my I-129F case was TOUCHED on 11th September 2010. What does all that means?

I desperately want to start working now as I have already spent a huge amount of money since my arrival in US.

Can you guys suggest what should i do... ?

Interview date is understandable for me but i don't understand why they are taking so long to process my work authorization application (I-765) ? I have been told that EAD always arrive within 90 days of filling AOS ( AT MAX ) is that true? If it is then in my case almost 80 days are gone already and I have not even received a letter stating that it is been approved.

I also want to mention that my sister in law applied the same nature of case (Adjustment of Status) in April 2010, with so many similarities like the same address in Queens, our financial sponsor was the same and she had her green card in hand in 85 days from the date of filling AOS.

Can you guys recon what the problem is ? is it my area ( Queens, NY ) or my typical Islamic name causing the delay ?

I could not even apply for a bank account/social security number or driving license - STUCK BIG TIME- Please HELP!! I really appreciate it.

I know it is frustrating to wait, and taking a look at the prediction on your timeline for EAD, it seems like you're a couple of weeks behind the other VJ crew, but a couple of weeks is not very much in USCIS eyes.

I know it's really hard to wait, but you won't be able to get anything done until you actually pass the processing times. If it's 90 days for EAD (I can't remember if that's "typical" or actually the stated processing time), then you have to wait that long before calling. On day 91, I would be on the phone if I were you.

Sorry I do not have better suggestions for you.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

I know it is frustrating to wait, and taking a look at the prediction on your timeline for EAD, it seems like you're a couple of weeks behind the other VJ crew, but a couple of weeks is not very much in USCIS eyes.

I know it's really hard to wait, but you won't be able to get anything done until you actually pass the processing times. If it's 90 days for EAD (I can't remember if that's "typical" or actually the stated processing time), then you have to wait that long before calling. On day 91, I would be on the phone if I were you.

It all depends on what local office you are going through. I send my AOS package at the end of May and still haven't recieved my appt letter for my biometrics!!! I sent a service request to USCIS and they told me that there currently is no capacity at my ASC. So it could just be that your local office is very busy. You can always put a service request in to USCIS by calling their 1-800 number.

It all depends on what local office you are going through. I send my AOS package at the end of May and still haven't recieved my appt letter for my biometrics!!! I sent a service request to USCIS and they told me that there currently is no capacity at my ASC. So it could just be that your local office is very busy. You can always put a service request in to USCIS by calling their 1-800 number.

You should make an infopass appointment ASAP. You are out of the normal processing times. Do not call that 1-800 number anymore and don't count on that Service request. I've done it in the past and it was a waste of time.

Unfortunately my local office for an infopass appointment is a 6hr drive away. We have recently contacted our congressman and senator hoping that they may be able to help. I am getting a bit antsy as well as I am 28 weeks pregnant, and only have about 6 weeks that my Dr will allow me to travel. So if we require an interview durning that time....we will have to reschedule and that could cause months of further delay.

I did get a response from my service request telling me that there currently were no open appts at my ASC and that I am in the queue to be scheduled.

I hope things would work out for you and you wouldn't have to reschedule the interview. But on the other hand your baby and your health are more important than anything. Good luck and keep us posted!I just can't believe your office is that busy! :wow:(F)

You should make an infopass appointment ASAP. You are out of the normal processing times. Do not call that 1-800 number anymore and don't count on that Service request. I've done it in the past and it was a waste of time.

thanks for the reply. Sure i will schedule it for next week. do you think they will be able to stamp my passport with "authorization to work" at the spot as three months would have passed in my case.

plus how do i find out where my case is now? what my local office is.....

No they won't. The stamp doesn't allow you to work anyway, you need the card. You'll just need to wait. Sorry.

Some cases get transfered to CSC (california service center) and they try to approve them without having an interview. If this happened with your case you would have recieved a letter telling you that it has been transfered there (it usually comes within a few weeks of your NOA1). If not then it is most likely at your local office. If you log into you USCIS account, on the menu on the left side of the page there is an "Offince Locator" option. You select that, put in your zipcode and it will tell you where your local office is. If you click on your case # to look at the status of it, and scroll down to the bottom of the page there is a link to "View recent processing dates for applications and petitions " where you can check the current processing times for both the CSC and your local office.

i checked the status by following your instruction... it shows my local office is New York City Federal Place and they are procession 30th March case any way I am not too worried abt my I-485 its just I-765 EAD i was concerned about... because they did not even TOUCHED my case status online upon submission of my finger printing.... I wonder if my Biometrics are lost....

its been 80 days and no update no TOUCHES and absolutely no letter from USCIS you know i mean.....

i think mine was like 73 days or something. i think you'll probably get it next week
