Ok, so after all the fussing and fighting with paperwork my fiances visa got approved. Well, it's been approved for some time now. Back in June of this year actually. She was preparing to come and her father fell deathly ill. He had an aortic dissection while driving, it's nasty business look it up when you get a chance. Anyway, she stayed with him until he pulled through the whole thing which is understandable. Because of this, it kind of threw all of the marriage plans out the window. Her Visa will expire November 18. Is there anyway I could get this extended? I was trying to get a little last minute wedding thing together, but every priest that I talk to tells me that these things have to be planned at least 6 months in advance. She'll be here September 28 and I have no idea what to do as far as getting married. Can I get a marriage license from anywhere or does it have to be from the embassy?

You can get a marriage license from your county clerk. Instead of trying to get an extension, you may want to have a quick civil ceremony so you are legally married within the 90 day window. Then, if you desire, can plan a larger ceremony at a later time.

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

You say her visa expires in November but she arrives in September? Why do you need the visa extended?

Timeline

She only needs to use the visa to enter the US before the visa expires. You don't need to get married before the visa expires. Before she enters the US she'll fill out an I-94 form. A CBP officer will stamp the I-94 with an expiration date that is 90 days after she enters the US. You have to get married before that 90 days expires.

A visa is permission to enter the US. It's not permission to get married. You still get a marriage license from your county clerk.

Have a civil wedding before the I-94 expires to satisfy the visa requirements. You can have a big ceremony later.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Aren't you super excited that your fiancee is finally coming? I sure would! You can request a marriage license from your city's county clerk's office as soon as she arrives, and you could get married in a civil ceremony within a week. Yes, I know, you would already be legally married, but later you could have your religious ceremony with all the glitz, decorations, guests, expense, etc. Make sure to save $$$ for the AOS fee before you spend all of your money on the wedding!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

i have a similar issue. kinda... our solution is to get married through they court (civil wedding) then have a wedding in the church when the church finishes all our paperwork.

I am not a catholic and i was married to a non catholic but we will have a catholic wedding so i need to have my first marriage anulled through the church even though i am already divorced, but the process takes on year or up to eighteen months.

so on our first anniversary we will have a church wedding.

but since yours only takes six months you coudl just get married again in six months but to me that would be confusing :) having two anniversaries to rmemeber hehe

Hello again!

You really do need to read the overview of the process available on this website and also through the USCIS website. Once you legally marry, you should complete the Adjustment of Status AOS(for the same filing fee you can also send the Employment Authorization Document and Advance Parole forms at the same time). Yes, you do need to send a copy of your marriage license and other paperwork, too. You need to make sure to send these forms as soon as you get married (which you must do within 90 days after her arrival). Again, reading up on the process to be entirely clear would be best. It is already a confusing process with lots of forms and paperwork, so you want to make sure you know how everything should be done.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Is that Adjustment of Status so she can become a citizen? We aren't trying to do that right now. A friend of mind and his wife has decided to do the green card thing so that she can return home for an extended period of time if she needs to. I'd like to do the same thing.

You adjust so she can get her greencard, it's not an optional thing, she can't stay on her K1 visa for life, it's used only to "get into" the US and get married and you get 90 days to get married.

You MUST do the adjustment of status as soon as possible after getting married or they'll be free to deport her if you never do it.

Please read the guides, it's really clear that you never bothered reading and this could hurt you.

I agree with Junita. It is very clear that you have not read the guides or done any substantial research on this proceedure.

The Adjustment of Status (AOS) is required for K-1 Visa recipients. The AOS process is the proceedure in which she will get her greencard. Becoming a US Citizen is much later.

Please read read read and then read some more. It is all laid out in the guides. After doing the research if you still have questions, that is what VJ is here for.

I know I'm being a bit late but since you have filed in California, I assume you are living there.... The fastest way to get a wedding license and get married is....Going to VEGAS it is going to take you 6 hours to get there and you can spend a fun week end with your fiancée! You can file for the license on line (Clark county)you need her names the names of her parents and same for you, you get your license number in a minute and then this number is valid for 60 days. Once you have that, she can come and you guys can have your JOP wedding whenever you want (just call to schedule few days in advance)In addition, paperwork to get married in Vegas is much much more lighter than anywhere else, you can call them but normally, a passport is OK (and, I think I remember a social security card for the US citizen)

THAT'S IT!

Then you will have time to adjust status and PLENTY of time to organize the fairytale wedding she is dreaming of....
