My parents just finished their interview with the USEM last Monday 09/13/10, now the embassy is asking that my husband submit form I864A. I was the only petitioner and didn't bother to submit this before considering that my income was above the required poverty guideline bracket for my household. Do we still have to submit this form and if we do submit this form how long will it take for my parents to get their visa after the embassy received the requested documents? Anyone have the same issue? Please help!

you have to submit whatever the @#$@#@$ the embassy tells you to submit.

what are you thinking? to ask here, at VJ, if you HAVE to submit something that the US Embassy IV Unit TOLD your parents that YOU have to submit?

I'm confused, really.

Who ya gonna believe ???

US Embassy IV/Manila

or

someone at VisaJourney.com ?

[my guess for 'why' - you and your husband had filed joint tax returns]

So you submitted a I-864, and now the embassy wants a I-864A from whom, your husband? The foreign parents? Or is it that your income is only just above the poverty line, so they are asking for a co-sponsor?

Due to the economic changes the CO's have been instructed to be more careful with the affidavit of support. This has come up with other VJ members where a co-sponsor was married (as Darnell points out). The I-864A is requested to show that the non-sponsoring spouse is aware of the commitment.

Submit what was requested.

My apologies for sounding harsh, I'm certain I was having a reaction to Do we still have to submit this form .

If US Embassy/IV Unit/Manila says so, yes, sorry, you must do so.

as for 'turn around time' - hard to say -

as is different 'queue' for handling submitted evidence for 221(g) requests.

If 'quick' - about 2 weeks.

If 'normal' - anywhere from 2 to 11 weeks.

If 'lagged' - 3 to 9 months.

It all depends, and it's all relative, to 'how that queue is' on the day that it's submitted.

Good Luck, however it turns out.

apologies accepted! MY bad i should probably have phrased it properly. Thanks so much for the info. With the embassy asking for I864A is this considered an AP? On the paper they gave my parents after the interview, it seems so vague and it didn't even mention about AP.

ya, it is a TYPE of AP normally hinged around a particular 'thing' with 221(g) -

in this particular instance - it's AP because of an additional document that was requested,

as opposed to 'AP for namechecks' - which , in itself, is a totally different queue, as well.

221(g) covers a lot of area, but IMO, whats being asked for, is one of the 'easier' ones, so might be a shorter queue. Maybe.

Good Luck !

Im going to be a heck of alot more tactful here for you because I know what its like dealing with stupid moronic forms. If your situation isnt settled yet then I can clearly say if they asked for someone to be a sponsor, as in joint sponsor, then the i-864A is what you'll need from someone, anyone willing to help. Keep in mind, this form says "Household member" AND "sponsor" The sponsor is of course the absolute person willing to cover you financially and with tax papers. The household member is the spouse living in the same household, so they fill out page 1. Both sign in their respective lines for a a signature, the household member signs their line and then further down the page is the sponsors signature. They mostly want last years tax proof papers and print outs, or if electronic filed, then have it sent from the IRS, they want it that way. Even if youve been approved already and this thread is old, maybe it will help others to know what to do.
