mandatory administrative processing?

You should hear something in the next few weeks if the pattern holds up...

It should be any day now... :)

This was day 97 for us and when we entered his passport number.... they were telling us to submit it! YEAH!

Did you get good news Ally?

I have talked to several lawyers now in the US and it looks like we prob wont go down the mandamus suit for various reasons.

It looks like to might be leaning towards another attorney who will be chasing up our case on our behalf and using all his contacts to get this through!

7months in AP go to try something!

I have received letter from my State's senator. which says....

I have received the enclose responese from us Embassy, New Delhi, regarding my office's inquiry on your behalf.

The Honorable

United States Senator

Dear Senator,

Thank you for your e-mail inquiry of December 2, 2010 regarding the immigrant visa application of ****** .

******'s application is pending under Section 221(g) of the Immigration and Nationality Act for mandatory administrative processing. Section 221(g) prohibits the issuance of a visa to an individual whose application is incomplete or inconclusive, or whose eligibility has not been firmly established. some application require additional processing, which requires additional time. When administrative processing is required, timing will vary based on the individual circumstances of each case and cannot be expedited. Please be assurd that we will contact him as soon as this processing is complete.

If we can be of assistance in any other matter, please do not hesitate to contact us.

Instead of typing such emails why do they not freaking actually take our files out and decide about our case!! Seriously it is frustrating.

Exactly...! It's more than 3 months now. It is frustrating.....I don't understand why they doing this to us..!

It is not good thing but not a bad thing either.

Everytime, they will open your case, they will know that there is a congressional enquiry on your case.

I hope/pray that you will out of AP soon.

Deep makes a very good point about the congressional inquiry being on your file.

However you have to check with the visa office when you phone for your regular update if in fact there IS a congressional inquiry outstanding.

I contacted my wifes congressman and they said that they sent an email to LegalNet asking for a congressional inquiry and update. However when I called up the Visa Office they mentioned to me that there is no CI on the system.

I am now in the process of emailing back the senator to again request a CI so that the visa office has this on record. Its always good to double chec.

On the topic of congressional inquiry, does anyone know the procedure that this is done in?

By my understanding the Congressman has staff that deal with immigration issues and they put in a CI to the relevant department. Or they send a email to Legalnet requesting a CI.

Does this sound right?

Deep; Does congressional inquiry affect the chances of getting (pending k1 under 221(G))visa in a positive way or it has no effect?
