That is correct...I applied I130... But at the interview, they gave her passport with a letter to submit all the requested documents to VFS.

When we submitted the documents with passport, they returned the passport with NO VISA.

After 10 days, we got call from Embassy "We can not find your passport. Did you submit it with documents?" When we told them that the passport was returned about 10 days ago to our home, we got email in 5 mins to submit the passport again one more time. We did and Visa papers were delivered with passport with visa stamp.

BUT in your case, they have kept the passport, which is a good thing. Hang in there.

GOOD LUCK and BEST WISHES

An update: I had contacted my senator's office and they put an enquiry into the case, the reply was forwarded to me and it basically says the same thing (section 221(g), etc.).

One thing I'm confused and worry about though.. I applied I130 like you did Deep2009. Yet repeatedly in the e-mails and the section of the embassy that's taking care of this matter they refer to the case as "the nonimmigrant visa application of ... <name, case number>" ... why do they continually label it as "non immigrant visa" when I applied through I130 to have her immigrate here as my wife? Any thoughts?

Thank you in advance.

This is strange... Did you put in NVC case number with the emails?

Why are they replying to as non-immigrant?

With my wife, the heading of the letter is always

IMMIGRANT VISA SECTION

U.S. EMBASSY

NEW DELHI, INDIA

Name and NVC Case Number

---Lets see if anyone else has clue to it.

I did put my NVC case number with my e-mails .. and well they have the case number so I would imagine it would only show up as an immigrant case .. so I'm not sure why they repeatedly refer to it as a NON-immigrant visa. Upon hearing that they correctly referred to your case in e-mails I am a bit more worried now.

I'll try to see if I can get any information. I'll call the DOS on Monday.

In about 10 days, we have the papers delivered to house.

Good Luck.

i think this type of AP is a little different, you didn't meet the basic financial requirements for your fiance to sponsor you. Once and if the CO accepts the sponsor and finishes up you should be done if there are no other issues. The other AP folks here a waiting on security checks

Congratulations amankular. I'm very happy for you.

if you have the time -- could you please summarize everything that you went through from the day of hte interview? for example, did they keep passport, if they gave back how long until they requested passport, how long they kept it? if you could post that, I think that would be appreciated by many people.

Thank you.
