That's the whole problem with interacting with law enforcement officers/agents. There is no black and white. It's all grey.

I meant, that in the eyes of a police officer, a felony is black and white, if they suspect that you've committed one, they will arrest you for it, and let either the watch commander or the D.A. sort out the final charges. When it comes to finally charging you and prosecuting you for something, yes, it is gray because a prosecutor would rather drop a charge down to something they can for sure win.

Enter Scenario

While driving a tinted Civic (to dark to be legal without specialty plates) the vehicle was pulled over by an officer that ignored a person going more than 10 MPH over the apeed limit on route heading into the city.

After the exchange of ticket the Civic driver answered the officers statment "Do you have any questions, Sir?"

The driver responded "How are we really to feel afe on the road when you ignore a blatant reckless driver speeding past you to pull someone over with tinted windows?"

The Officer politely responded "I did not see that driver." (for the record the speeder sped past him after passing the Civic less than a 1/4 mile back)

The next day while the Driver of the Civic went to do errands he was pulled over again by a county sherriff for the same reason.

Even though the driver was very respectful at this time the sheriff gave him a hard time even threatening to arrest him for reciving a 2nd ticket for the same reason even though it was less than 24 hours from the first ticket and no chance to remove the tint was possible.

Meanwhile Early Monday Morning crossing the Border of the state to drive to an airport the a State trooper of the new state less than 1.5 hours away from the original ticket location pulls the Civic driver over for none other than dark tinted windows. (Mind you it is 3am on the interstae and there is no real way to tell unless you stop the person)

The Respectful trooper and respectful driver depart each other with no ticket but in parting the trooper stated Mr driver I really appreciate your respectful attitude and I always hope you remeber that in the future.

Moral

The Civic has specialty plates and the Driver never asks smartaz$ questions regarding tickets.

Mean while after that ticket

What is the point of you posting this scenario? Is it legal to have the tinted front windows? No. The bit about passing over someone driving 10 mph over the limit to give the person with the tinted windows a ticket is tantamount to a child saying "I know I was wrong, but my sister came home 30 minutes after curfew last night". Who cares, the driver of the civic was still breaking motor vehicle laws. Yes, both were wrong, but really, is 10 mph that much more egregious than a potential safety hazzard of driving with the front side windows tinted? Maybe in your opinion it is, but clearly it isn't in the view of the police.

Most of our cars can do 100 MPH or above. When will the silly federal speed limit be increased from 55 MPH to reflect car's ability and people's aptitude to drive comfortably and well at higher speed? Most people already drive that 80 to 90 MPH.

If you are pulled over at night, make sure to turn on all the lights inside your car before the copper approaches you car. Keep your hands visible and make all of your moves deliberate and announce. if you are going to open your compartment, say you are going to open your compartment. Coppers are always antsy and would like nothing more than to tase you or shoot you. If you have passenger in your car, make sure they too keep their hands visible and don't make any unnecessary moves.

Don't speed.

Most of our cars can do 100 MPH or above. When will the silly federal speed limit be increased from 55 MPH to reflect car's ability and people's aptitude to drive comfortably and well at higher speed? Most people already drive that 80 to 90 MPH.

If you are pulled over at night, make sure to turn on all the lights inside your car before the copper approaches you car. Keep your hands visible and make all of your moves deliberate and announce. if you are going to open your compartment, say you are going to open your compartment. Coppers are always antsy and would like nothing more than to tase you or shoot you. If you have passenger in your car, make sure they too keep their hands visible and don't make any unnecessary moves.

New York Jets receiver Braylon Edwards was arrested on a drunken driving charge in New York early Tuesday morning...

The 27-year-old Edwards was pulled over for having overly tinted windows in his Range Rover. He was arrested at 5:15 a.m. after police smelled alcohol and administered a breathalyzer. According to the New York Post, Edwards blew .16 on the breathalyzer -- a blood-alcohol content that is twice the legal limit.

1st cop: driver asked smartypants question = rec'd a ticket

3rd cop: driver was respectful = no ticket

lesson learned.

some vehicle makers have made adjustments :( hit 95-97mph and you will feel the vehicle begin to bog down... continue and vehicle will cut off, let off gas and vehicle resumes lower speed just fine.

for those with a need for speed, there's still the muscle cars ;)

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.

Corky, I got the reference that he was making, it was however superfluous to the point I made as I clearly made the distinction regarding officers lack of disgretion pertaining to felonies. I guess I figured that by excluding misdemeanors and infractions from that statement that you would logically come to the correct conclusion. You didn't however, further proving my point regarding your grasp of the topic at hand. You clearly cannot see beyond your own nose, or your own experiences. Sad really, but you really should run along and let the adults talk here. You are grasp of law enforcement is painfully juvenile at best, willfully ignorant at worst.

The Initial Cop most likely hit the airwaves or posted something about my vehichle and to watch out for the Smartaz$ driving it.

The Sheriff that pulled me over the 2nd time about 20 miles away the next day wasn't buying the respectful attitude or mind set I was in and was trying teach me a lessen

The 3rd stop by the trooper on the state border that stopped me on the way to the airport could not determine my tinted windows until I was stopped unless of course he had super vision of some sort but his parting comment stuck "I really appreciate your respectful attitude and I always hope you remeber that in the future."

Is it possible it was just my luck to be stopped on Friday, Saturday and then Early Monday morning after not driving on Sunday or was there more envolvement?

The Moral of the story is do not be Smarta$z to the cop that pulls you over.

I dont' think i'm being overly sensitive. Nab came into the thread ignorantly trying to pass off his little anecdotes as some sort of evidence, when in fact it was just him making sh!t up. No, I got your point, but I don't think you got mine. You posted that scenario in response to my post about certain crimes (felonies) being black or white, not disgression on the part of the officer. There is disgression allowed when it comes to lesser crimes and infractions. This would include "fix it" tickets like an illegal window tint.

The scenario you posted was moot because by your own admission, you were guilty of the infraction. Yes, it was a bit overzealous on the part of the 2nd cop, but it was well within the guidelines, and you were still breaking the law. I think the actions of the third cop are more appropriate. I'm not sure about your state, but where I live, there is no actual fine for those sorts of tickets, just a matter of fixing it and taking it to the highway patrol to sign off on a paper that you made the vehicle changes to address the citation.
