Got my visa from F2A petition, wanting to marry Filipino bf after 1-3 years of LPR status. Is it possible?

Hi! I recently passed the medical and got my visa under F2A category. I will be leaving for the US in a month. I have a boyfriend I would have to leave behind but we are planning to get married after 1-3 years.

I would like to ask if I can petition him and marry him after 1-3 years, if I got my Permanent Resident status as an F2A (unmarried child of permanent resident)? Would I not lose my eligibility as a "child" because I'd become a married daughter already of an LPR?

And would I still file for adjustment of status once I get to the US, or is it already automatic to have my GC and EAD delivered in a month after arriving?

Hey... you can marry your boyfriend as long as you already have your greencard with you.. that's what I did.. I came in the United states 3 years ago as an F2A and then got my GC... after 2 years, I married my boyfriend.. and I filed a petition for him last april 2010, now it's already approved.. seems like F2A category this year is speeding up their processing times and approval believe me.. so now, we're waiting for further intructions from NVC and I'm guessing it will only take about 6 months more then we can finally be together here in the U.S. =)

By the way, may I know your timeline if it's ok? can you post it... dates from the time your I-130 was approved by USCIS until your present status.. i wanna know the exact dates and steps.. thanks.. and by the way, where in the U.S. will you be staying? When r u coming?

Hey... you can marry your boyfriend as long as you already have your greencard with you.. that's what I did.. I came in the United states 3 years ago as an F2A (unmarried child of LPR under 21) and then got my GC in the mail after a month (no need to apply for AOS)...then after 2 years, I married my boyfriend.. and I filed a petition for him just last May 2010, now it's already approved..It took only 4 months!!! seems like F2A category this year is speeding up their processing times and approval.. believe me.. so now, we're waiting for further intructions from NVC and I'm guessing it will only take about 6 months more then we can finally be together here in the U.S. =)

if you already passed your interview, congrats you are a LPR, no need to file anything in the US, you are a residente, how you got your GC doesn't matter when you marry and file for your spouse.

When you enter the US, you don't need an EAD, you'll get your GC.

Technically,.... no.

You don't become an LPR when you receive an immigrant visa. You become an LPR when you enter the United States with that immigrant visa.

Hi sacarabi.. i noticed you didn't post your timeline yet..busy eh? =) anyway can you just tell me the date when your I-130 was approved so I'll have an idea as to how many months more will I be wait before my spouse gets interviewed in the embassy in manila. Some say it's 6 months, I wanna know yours.. =) My husbands case (I-130 F2A) just got approved this week. I'm just so excited.. please let me know. :) thanks

honeyB: I have posted my timeline now. by the way, since i received my noa2 i prepared my documents 2 months in advance because some of them may take weeks to prepare. I ordered birth cert copies online at the NSO website. You also need some good evidence to assure your visa approval. i took all my mother's remittance receipts, more than six photos together throughout the years, letters and emails (proof of relationship) and more importantly, her financial documents and assets should all be presented (photocopies of cars, houses, properties owned) and copies of bank accounts, certificate of employment and salary, last year's latest ITR and W2 statements (proof of financial support). And I think that's the reason why I was approved, everything was organized and complete.

The downside is the interview date which will take about four mouths from the petition being approved. (I was approved on April, I was interviewed on August). Therefore once you receive emails from NVC you should send back everything they want at least the same day they sent them to you. The documents your husband should sent should also be delivered on the priority mail so they will be received earlier. Because you will be scheduled earlier for your interview if they receive your documents faster (to make you "documentarily qualified", as they say).

The medical is quite easy, they just gave me DPT boosters. Some of the people I encountered had about 4 vaccinations on the same day, so please check the vaccine list if he had already been given the required shots. It will take two days for that process..

The visa interview will be ok as long as he brings everything with him, some people forget to bring their NBI and police clearances which should not be expired during the interview as long as the pics and evidence I told you about.

WOw.. thank you for the very helpful info... =) now I already have an idea as to how long and what things to prepare beforehand. I found your case similar to my husband's and at least yours is the most recent case (which is this year 2010) so somehow I could relate it to my hubby's case.. If I check back on my timeline 4 years ago, it took me a year from the time i got NOA2 to the time of interview..processing times were slow during those times.. You're so lucky you don't get to wait that long.. Lucky for me and my hubby too this time! thanks again for the info.. hmm I wonder how far new mexico is from arizona.. got a facebook acct? =)

Yes, It's April 2009.. then my case became "current" on the visa bulletin on May 2010.. They were just waiting for a visa number to give me.. But since yours is already approved and in the visa bulletin they are currently processing those Philippine F2A petitions dated April 1, 2010 and earlier, I think your husband's case will be processed really faster. =)

Hi HoneyB! You mentioned that you filed for your husband's petition May of 2010 and it got approved after four months. I'm just curious what his priority date is. Is it also May of 2010? I'm not sure kasi if your priority date same as the date USCIS received the petition. I am also an immigrant and I got here 8 months ago. I've been thinking about marrying my gf back in the Philippines. I've been monitoring the Visa Bulletin in the past 3 months, it's moving really FAST!!!! That's so promising. BTW I live in Seattle.
