Hi,

We recently submitted DS-230 with all the required documents. NVC replied saying that the Birth Certificate I submitted was not an original. I was born in Libya to Serbian parents (Serbia is my native country) and they registered my birth at the Embassy of Serbia in Tripoli, Libya. Since then my Birth Certificate has always been issued by the Ministry of Foreign Affairs in Serbia. I cannot obtain a birth certificate from Libya as I am not a Libyan citizen. Is there anyone else in a similar situation? Would a letter of explanation be sufficient since I have already submitted the only original birth certificate that I have?

I would be very grateful if you could post your comments and suggestions.

Talk to NVC supervisor and explain your situation clearly and proceed as what they say. Or email to NVC with all the details making the subject ATTN:Supervisor Sue with your NVC Case#. In addition talk to a live person as well - not the first level, second level supervisor.

At the end, suggest them the notarized affidavits from your parents in addition to your Serbia BC would be suffice.

yes i was aware of the instructions posted there (they were also mailed to me in the RFE checklist response letter)...but the trouble is I don't know which government authority needs to say that it is unobtainable? The Libyan birth records? How would I even attempt to approach an institution of which country I'm not a citizen of? Even if I could, through my country's consulate/embassy, it seems like a very long, drawn out process which could possibly take months...why can't they just accept an official birth certificate that is issued by the country of nationality...they obviously verified my birth at the time and are issuing an official document saying so - why is more than that needed...it seems funny that secondary evidence such as a parent's affidavit would hold more weight than an official government issued birth certificate...

Just to give everyone an update...if interested. The explanation letter apparently worked as we got a notification that our case was completed at NVC on Oct 18, more than 2 months after we sent in our DS230- :(. Now we have to wait for the interview to be scheduled, for which supposedly missed the scheduling window for November (first two weeks of the previous month - grrr). I wonder if this will be brought up again at the interview....I still don't understand why on our case completion letter the "Country of Chargeability" is still stating Libya....As I understand, this has no effect on spousal immigrant visas, so I'm going to ignore it. It still is bothersome though....thoughts?

NVC will pass it. That does not mean you are done. CO is the person who decides it finally. Chances are there to bring it up at the interview. Prepare very well for it. And Good luck to your interview :thumbs:
