Hi there,

I married my wife with a K1 visa, and her daughter is here on a k2. ...her k1 visa on their passports expired but I called USCIS and they told me that its not a problem to file even though it is expired. My question is the fees wich I would have to pay and the steps to take from here on. What fees do I exactly have to pay and what forms to fill out? I know I would also need advance parole and permission to work. Im confused on the other steps though like biometric stuff and some kind of health surgeon that has to fill out some vaccination forms to turn in. If anyone can touch on those subjects It would be really appreciated. Thanks for looking.

AOS- Went in for Biometrics. Dec 15th at 8am. Pretty fast..took bout 20 min in and out for mother and child.

AOS- Recieved NOA2 Jan 10th. Appt set for Feb.8th at 1:30pm

AOS- Approved Feb 8 Permanent residency

thanks for the link...although i still need someone to clarify the fees that i have to pay. the page on the uscis site is kind of confusing.

The details are in the instructions for the I-485. But, to save you some reading... Your wife's AOS will cost $1010 total. The cost for her daughter depends on a few factors. If she's under 14 and you file her daughter's AOS as the same time as your wife's then the cost is $600. If she's under 14 and you file AFTER you file for your wife then it's $930 (you can't file for her daughter BEFORE you file for your wife). If she's over 14 then it's $1010, regardless when you file.

The details are in the instructions for the I-485. But, to save you some reading... Your wife's AOS will cost $1010 total. The cost for her daughter depends on a few factors. If she's under 14 and you file her daughter's AOS as the same time as your wife's then the cost is $600. If you file the AOS at the same time as the EAD and the AP, there is no additional fee, it is waived.

Your stepdaughter also needs an EAD and AP, and those fees are also waived.

So the AOS fees would be:

$1,010 ($930 + $80 biometrics fee) for your wife, AND

$600 for her daughter IF she she under 14 years old OR

$1,010 IF she is 14 years old or older

AND all 3 applications for each person are submitted at the same time.

As the previous poster mentioned, there's no fee for the EAD and AP applications when they are filed in connection with an AOS application. It's $1010 total for all fees.

Her visa was canceled when she entered the US. A K1 is a single entry visa. Once it's been used for one entry into the US then the expiration date on it is meaningless. Her lawful presence is now governed by the date stamped on the I-94 card that was stapled into her passport. She is still eligible to file, even if the I-94 has expired. The fees are the same.
