Hello Everyone! I am new to this site, and actually happened upon it while doing research on the visa process. Me and my sweetie just got married in August and wanted to immediately start looking into getting him here. I actually am really stuck now, and it may just be that I am being overly cautious, but we are miserable in different countries and do not want to make any mistakes that will prolong the application process. Plus, I may be going to his country and waiting there with him until the approval comes thru, and I dont know how long I can last without my fastfood and usual conveniences...lol

Question??

My name on my birth certificate is Kimbely but on my passport, driver license, and all other documents it is Kimberly. (the hospital made a mistake with the spelling of my name), when we got married, we were advised by the officiant that he would have to put Kimbely on the marriage license application and that would also be on the license. My question is should I spell my name correctly (Kimberly) on the I-130 app or should I spell according to whats on my marriage certificate (Kimbely)? Keep in mind that all of my other supporting documents (ie. tax returns, paystubs, phone bills) will have Kimberly on them.

Question??

I am completing a coverletter for the I-130 app, and wanted to know should I put that I am applying for a K3 Visa or an IR-1/CR-1 visa? (all of this information is starting to confuse me..lol)

Thanks in advance for any responses!!!

Kim

Hi Kim

I am pretty new to it all as well .... what i discovered is that the IR1/CR1 is the best visa. IR1 is Immediate Relative for marriages over 2 years (10 year visa with no conditions) and CR1 is Conditional Relative under 2 years marriage (2 years Visa that needs to be adjusted before the 2 years is up)

Its really confusing i have just filled in my forms and they nearly drove me mad :) lol

Not sure about how you would go about the name though maybe there are a few old Sages on here that could help with that one .....

Keep in touch cause i am realising now its important to know people going through the same :) Good Luck

Why don't you get your name corrected on your birth paper? Jamaican embassy is very finicky. They will want supporting paperwork as to why your name is different from what is on your birth paper and from what is on your supporting documents. This kind of remind me of my mom when she was appyling for my brothers. She had gotten a certified letter because on my siblings birth paper she had many variations of her name on it. So, the justice of the peace basically said that she was also those names that were on her childrens birth paper. If you can't amend your birthpaper, just have you name changed and add the "r" to it as long as its not a finacial burden to do it. But I would send an email to the embassy multiple times until you receive the same answer and inquire about the concerns you have about your name being mispelled. Good luck!!!

I agree. My husbands last name was spelled incorrectly on his birth certificate and he had it corrected right from the start.

Hello Again!

Thanks everyone for your responses!!! Much appreciated! to goldylox > thanks for the explaination on the CR1/IR1 issue, I was totally confused. I will put on my coverletter that I am sending the I-130 in request of a CR1 Visa, and you're correct it is definitely nice to have someone to confer with that is going through the same process  .

Also:

The great news is my sweetie called me today and said he received the marriage certificate, and guess what? Jamaica listed my name correctly as Kimberly, even though the officiate spelled it as it was listed on my birth certificate (Kimbely). So I can submit my application with my name spelled correctly. I will also take the advise from MRStee and Sasha_Cool and getting my name corrected on my birth certificate and social security card immediately. Just in case the consulate requests a copy of my birth certificate or social security card.

:)

Thank you all!
