Extensive Back Ground Checks by USCIS

I have filed a fiancee petition for my fiancee on 02/16/2010 at CSC. Since then I have

only received a receiving notice from USCIS. I have not asked to provide any type of

additional documents. I have been inquiring about the case since last two months with

USCIS, but every time I get a response that back ground check is not complete and they

can not render a decision. Even the California Senator's office checked into the situation

and they received thee same answer. Today I got the email from USCIS with another

following response

The petition requires an extensive background review compared to other petitions receive in our office.

As previously mentioned on our August 17, and 26, 2010 response, we will not be able to render a decision

until this background check is completed.

I am really sick and tired of hearing the same answer. On the other hand my fiancee is fighting with me

and she thinks I am not doing anything, because nothing is happening. She Dose not understand how the

United States Government work. I mean there is nothing in my hand. If anyone have the same experience

please share and help. Thanks

Me , i have told you that before and background check is going to take from 120 to 180 days , so you will need to wait until they finish , By the way i have received my NOA1 in jan and still waiting and they didn't ask for any evedinces or anything ,by the way , iam the beneficiary and i fight with my wife too and i though she wasn't doing anything lol.

i will go say srry to her :)

But same 120 days to 180 days are like 4-6 months, but my case has been filed for 7 months, I have already waited

for more then required time. I am not sure what is going on. I wish there was a answer to it.

Can i ask why your cases need extensive background checks? are they for you or your fiance? does it have to do with where they are from or things they have done?

just seems a bit odd that it takes so long to do a background check, i mean jeez are they sending cia agents to their doors?

Interview: 2011-02-08 - Approved

Visa Printed: 2011-02-10

Sent to 2Go: 2011-02-14 (scheduled for noon delivery as per consulate)

Pckup @ 2Go: 2011-02-15 (Will hold at routing Hub for same day pick up)

Well Max121, that is the case, don't know what is going on. I am not sure

who they are checking into. I do have a criminal record from year 2003.

But that case is close and clear. I have submitted all the documents.

That criminal case dose not related to I-129f petition at all. Other

thing I can think of is that I have divorce from my first marriage.

But proper documents were also sent with the original petition.

My fiancee dose not have any prior marriages or any type of criminal

record. She have been to USA once on P3 visa and went back to India

with in the time limit of her entry. I don't care what they are checking

or investigating, All i want is this thing to move forward. They need to

get going on what ever they are doing and get it OVER>. This is way out

of control

It sounds like one of you where a close hit in name checks. When they run those some people fly through because they don't match any names, some slow up because they match name wise but obviously aren't the same person ( a 20 yo matching a 50 yo persons name ) What can really slow you up is hitting with a person that matches , same name, age , country of origin. They have to take some time to prove you aren't that person.

This will not be over quickly. You will not enjoy this.

I don't want to make you upset...Delhi embassy is very picky with 129F petition.

I know a person had same situation... His VISA was denied at the Embassy.

She went back and married him and filled 130... Think about it now.

well, i have been waiting already for 8.5 months now , and still waiting for the background check to be finished , im very frustrated ,by the way , have you contacted your congressman or senator or governer ?

to both Sam and the original poster, i would highly recommend getting an infopass appt at this stage. that will allow you to meet your local uscis agent who will be able to look into your file (may not have access to the same exact file that the adjudicator is looking at, but can see about when and how many times it has been touched, what its path and progress is etc). should get some more info that way...you can make the infopass appt on the uscis website.

NVC:
04-29-2010: INTERVIEW ASSIGNED FOR JUNE 10TH IN CHENNAI CONSULATE, INDIA; 06-10-2010: INTERVIEW - VISA APPROVED!!!!!
06-18-2010: Entered US - NEW YORK CITY and 08-16-2010: GC received! (nearly 2 months after PoE) woo hoo!
AOS for permanent 10 yr green card:

04-02-2012: NOA of I-751 and 1 yr extension of temp green card

05-03-2012: Biometrics appointment

12-18-2012: 10 yr Green card approved; 12-22-2012: Green card rec'd

N-400 citizenship:

06-19-2013: N-400 mailed; 06-22-2013: N-400 rec'd at Dallas lockbox

10-3-2013: Interview date - APPROVED!

10-18-2013: NATURALIZED - We are done with USCIS!!!

Thank you for the advice but i know how many times it has been touched , and its at the FBI for background check anyways and USCIS has no power to know when is it going to finish there.

there has to be some sort of time as to when you can expect for the FBI to be done. They cant just leave you flapping in the wind, what happens if they lose your file and if you dont knwo how long it generally takes you have no idea if something is wrong.
