Interview or no Interview\Green card or no Green card

This is all very confusing because I have seen a great deal of people that never had a interview and/or your case was transfered to a Service Center. I also see that a great deal of people are receving there green card pretty much right away. What gives with this?

From my understanding there was a two year wait until you recived a green card based on Marriage/K Visa.

Also why is it that some people never have interviews and there case is just sent off to a service center to complete processing? Does any one have any idea what is going on with USCIS? Because I'm lost as far as these details go, I really truly am.

The approval without interviews seems to be a fairly recent phenomenah so we are not particularly sure yet what the criteria are although the provcess seems to be as follows: a complete, uncomplicated AOS application is submitted to a regional office that has a large backlog of cases waiting for approval; the application is transferred to the California Service Center to reduce the backlog at the regional office; the application is processed at CSC, and since the case is uncomplicated and straight forward, almost always is approved without an interview. As mentioned before, these seem to be uncomplicated, straight forward applications from overcrowded regional offices that have a backlogged work load.

When people talk about getting their greencard, they are including getting their conditionial green cards as well. Basically, once the AOS is approved - whether it is iwithin 2 months of submission or 2 years - the applicant receives a green card. If the marriage is less than 2 years old when the AOS is approved, the green card has 'conditions' and is only valid for 2 years. The applicant must apply to remove the conditions before those 2 years expire. If the applicant has been married more than 2 years when the AOS is approved, the green card is a unconditional green card.

It is best to plan that any AOS application will require an interview, and then be pleasantly surprised if it turns into one of those lucky ones approved without an interview.H Hope this helps to clear up your confusion a bit.

Some people get their 'Green Card' (Permanent Resident status) on the day they enter the US, for others it can take 3 months to 3 years.

I guess understanding the source of your confusion would help clear up the rest---which part can we explain better?

It depends on what type of visa you came here on. I think the CR1s are the only ones that will get an unconditional GC. and those using the K3 that have been married over 2 years. This is my understanding.

I don't know if there is really any criteria for which cases are transferred. I know of two cases with RFEs for missing information and both had previous foreign spouses. One had a substantial age difference in the current marraige. Not what I would necessarily consider straightforward (but I am not making the criteria :hehe: ) Both had their cases transferred to CSC and were approved without interviews.

I have heard that the cases that are approved without interviews can face tougher interviews when it comes time to lift conditions.

:o Where did you hear that? I thought that transferring K visa based AOS cases to CSC was a relatively new phenomenon. Have you actually heard of someone who had AOS approved without an interview and subsequently had a tough interview when lifting conditions? Is this a known trend? Just curious, because we were approved without an interview.

A couple who had their interview ahead of us asked the adjudicating officer about the approvals without interview and this is what he told them. Maybe he was just trying to make them feel better about having to come in?

I actually know quite a few people from Yahoo Groups who are not a part of VJ that have had to go in for interviews to lift the conditions. Maybe it is more common for couples where the man is from ME/NA? One had a very brutal interview, they were videotaped apart and asked intimate questions. It took three years for this couple to get the conditions lifted.

yeah when i read from one post here that a couple was approved w/o going thru any interviews, i was surprised too. i thought most of the people need to go to interview before getting the greencard? i got a letter requesting me to attend the interview in Oct too. I got the letter pretty fast though... that's also unexpected. But i'd rather if they actually approved the case w/o asking me to attend the interview! :P

Thanks for the info; I guess I'll find out in a few years! But I find it heartening to read in the guide here that most couples are not interviewed when lifting conditions, particularly if they have submitted ample evidence of their married life together.

Me too; I had no idea getting approved without an interview was a possibility until I got the NOA stating that my AOS case had been transferred to CSC. I thought "what the heck does that mean?", came to Visa Journey to do some research, and was gobsmacked to find out that most AOS cases transferred to CSC are approved without an interview.

So i guess it means if we provide more than enough evidence about our married life for the lifting of condition application, we may not be asked to attend any more interviews?
