What status does my wife hold?

My wife came to the US in mid June, and we got married in early July. Her EAD was approved yesterday, but we are still awaiting AOS.

She wants to take courses at the county college. One of the questions is:

17. Are you a U.S. citizen?

Yes (If yes, please skip to question #18)

No (If no, please answer a through e below.)

1. If not a U.S. Citizen, what is your country of citizenship?

2. If not a U.S. Citizen, are you a permanent resident of the United States? Yes No

3. If a permanent resident, what is your alien registration number?

4. If not a citizen or permanent resident, what type of status do you currently hold?

Anyone know what we should do??

AOS, EAD, AP:

07-22-10 : Sent packet

07-23-10 : Delivered

07-29-10 : NOA1 (all 3)

08-31-10 : Biometrics appt

08-31-10 : I-485 case transferred to CSC

Touched 09-01-10 (I-485 and I-765)

09-03-10 : Transfer hard copy

Touched 09-09-10 (I-485)

09-13-10 : I-765 & I-131 Approved!

Touched 09-17-10 (I-485 and I-765)

09-17-10 : I-512 Received (AP)

09-20-10 : Received EAD

10-20-10 : AOS Approved!!

10-21-10 : AOS Card Production

10-28-10 : Green Card Received!

Are you a US citizen?

No. [Representing yourself as a US citizen if you are not is VERY VERY bad. Never ever ever give anyone cause to think you are claiming to be a US citizen if you are not one. That's one of the 3 unrepairable "crash landings" [the others being material misrepresentation and entry without inspection.]

1. Country of citizenship.

Brazil [assuming, from your membership info here. :)]

2. Permanent Resident of the US?

No. Not until she gets a GC. Its "Resident Since" date is always on or very close after the date on the "Card Production Ordered" email. If you haven't gotten that, she definitely isn't a PR, and even if you have, she might not be quite yet.

3. If not PR, A#?

She actually has an A# you can give them anyways. It might help, letting them know she is in the system as a legal immigrant, etc.

4. If not citizen or PR, status?

K-1 fiancee visa entrant and Adjustment of Status [Green Card] applicant.

Her Green Card should be in the mail. Once she gets it she is a permanent resident right?

What is the difference between EAD and AOS status? I thought AOS makes her a permanent resident...

For #4 I put Fiance of a US citizen, since AOS applicant is not a choice. Spouse of a US citizen is though, should I put that instead?

She's "adjusting status".

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

She is a PR once the "Resident Since" date on her GC has passed. Unfortunately, there's no real way to find out that date until you have the card in your hand to read. [if you've received your "Card Production Ordered" email, you /might/[no guarantees] be able to get the "Resident Since" date from the USCIS info line.] The date will definitely be before the card was mailed, which will definitely be before you receive it, so she will for sure have been a PR for several days by the time you receive the card.

The approval of the AOS application makes her a permanent resident [conditional], authorized to live and work in the US, for a period of 2 years. The approval of the EAD application makes her work-authorized [authorized to work in the US] for a period of 1 year. AOS approval supercedes the EAD approval and renders it irrelevant.

If you are married (which your timeline shows you are [and you'd have to be, in order to even file for AOS [it needs a copy of the marriage certificate, or it will be denied]]), you should select "Spouse of a US citizen." In general, information on a form [uSCIS, tax, or anything else] should always be an instantaneous snapshot of reality as it is at the time and date you sign the form.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
