Hey guys! My wife went in for her naturalization interview (in Atlanta, GA) and she was one of the lucky (more like unlucky) few that are now stuck in the security checks before she gets the Oath Letter. What was more weird is that the Interviewing Officer told her that she should expect a letter in 2-3 days after the interview... But now it has been exactly 30 days after and nothing has changed.

I did call the USCIS hotline and the person on the other line said that an interview letter was sent, but I told her that it is the incorrect status and that my wife has already had her interview and now she is in the security check black hole. When I told her to transfer me to her supervisor or an Immigration Officer, she said that she was not able to and that I had to setup an InfoPass appointment with the Local Office to talk to an Immigration Officer at the Local Office.

So what do I do now:

1) Am I overreacting that it has only been 30 days and still need to wait?

2) The USCIS officer said that after 90 days from the interview they can send a request to the Local Office for status, do I need to wait for that?

3) Should I contact my US Representative and/or Senator now? If so, do I call their office directly, e-mail them, or send them a certified letter? Or all of the above?

4) I also read that I can contact the FBI at (304-625-5590 option 3) and give them the alien number to check if the name check has cleared. After contacting them and saying that it is now back in USCIS hands, do I have more leverage to contact USCIS about my case?

5) Any other suggestions that you guys might have to push this along?

Sorry to hear about your experience. It is certainly frustrating. I read that there are a few people who go to interview only to be told their security clearance is still under review. More than likely this is the name check. Unfortunately, the legal changes regarding 'name check' time limit upon petitions does not apply for naturalization so you will need to wait until this has been cleared before they are able to approve your case.

If you make an info pass you will likely be told that same and to wait and be patient. Certainly, if it makes you feel better you can do an info pass. It is always reassuring to an extent to hear it direct from an IO - it easers the frustration for 30 days more blink.gif... On a positive note at least it has no effect on your status as a legal resident etc. I hope you get your oath letter very soon!!!good.gif

My understanding is that the FBI no longer respond to status requests of Namecheck. I believe it also states that on their website. It tells you to contact USICS to obtain status of the check. You could always try a info pass but be prepared to get the cold shoulder with such comment "still awaiting background check results" and not being specific about 'namecheck'. Of course when namecheck is cleared you still have to wait for them to process your oak date headbonk.gif so maybe it is cleared now and they are just processing the file for oath whistling.gif

I agree that you probably won't get any additional info doing an Infopass. If I were in your situation, I would call the misinfo line again. You are guaranteed to get another person, and most people who answer the phone are willing to transfer you to an IO. Even if you don't learn anything new, it will be comforting being told by the IO, as Happychap said. Good luck! :thumbs:

WOW headbonk.gif you not heard? that is crazy. They say a decsion has to be made within 120 days from your interview. You are either past that or fast approaching it. Did you make an infopass? I would first make an infopass just to speak to someone other than the hotline. Also, seeing it will be that local office that is dealing with your case, and who will ultimately be the ones in sending you your oath letter,. they will be able to advise you much better. They may even give you your oath date there and then seeing you have waited for so long. Assuming of course your namecheck has cleared. You file may just need a little shift by you making an infopass..

Hey guys... still nothing in the mail. Should I go after them through my congressman?

Well technically I'm approaching 30 days on the 17th of November. I'm going through my senator to see what they can dig up. If nothing, would going through my second senator and my congressman make them "mad" or delay the process all together? Just weighing my options for if I do not get any more info from my senator.

Definitely will do another InfoPass when 120 days is approaching to make sure they know it is "coming". Thanks for the replies!

I've been reading here for years and in most all the cases, contacting a senator forces the case to suddenly move forward. It doesn't hurt the case or "make them mad". Good luck!:thumbs:
