What if the child does qualify as an orphan? I ask becuase my wife and I just had a little boy. We want a little girl and have discussed adopting in the RP if the whole process cost less than $8,000 USD.

I think you will find that it cost more then $8,000.00, Don't forget that the IRS offers a Tax Credit of up to $13,170 to adoptive families

Relative Adoption

The Philippines allows U.S. families to adopt relatives living in the Philippines that are within four degrees of relation. That means adoptive parents are eligible to adopt a brother, sister, niece, nephew, uncle, aunt, first cousin, grandchild, great grandchild, great-great grandchild, grandniece or grandnephew. If the relationship is beyond four degrees, a first cousin’s child for example, an adoption from the Philippines would not be possible. Adoptive parents must be able to provide proof of the relationship in their dossier.

Philippines Adoption Eligibility Requirements

In addition to the USCIS eligibility requirements for prospective adoptive parent(s), the Philippines has the following adoption eligibility requirements. If you feel you are not eligible to adopt from the Philippines, or you are unsure, we may be able to work with you. Please contact us for a free case-by-case consultation regarding your Philippines adoption.

  • Citizenship: One adoptive parent must be a U.S. citizen.
  • Age: Adoptive parents must be at least 27 years of age; there must be at least 16 years, but no more than 45 years, difference between the younger adoptive parent and child.
  • Marriage Status: Married couples are eligible to adopt if they have been married at least three years; Single men and women are eligible to adopt children six years and older and children with special needs.
  • Previous Children: Families with three or more children in the home are not eligible to adopt a child younger than 6 years of age; families must wait one year from the birth or adoption of a child before filing for adoption from the Philippines.
  • Health: Parent(s) with any history of Cancer are not eligible to adopt from the Philippines.
  • Religious Affiliation: Parent(s) must demonstrate a relationship of at least 5 years with a religious or spiritual organization.
  • Income: There is no minimum income required. However, you must meet the income requirements provided by USCIS for the child to immigrate.
  • Criminal History: Applicants with a criminal history of child abuse, violence or domestic violence are not eligible to adopt.

The adoptive parents must have had legal custody of the child for at least two years. “Legal custody” must be awarded by order of a court or recognized government entity. The start of legal custody begins the date the adoptive parents were granted legal custody of the child, or the date the adoption was finalized, whichever comes first (in the Philippines, the grant of custody is retroactive to the date the petition was filed). An informal custodial or guardianship document, such as a sworn affidavit signed before a notary public, is insufficient for this purpose.

The child must have physically resided with the adoptive parents for at least two years prior to immigration. During this time, the adoptive parents must exercise primary parental control. Evidence must be presented to establish that the child and the adoptive parents had a bona fide parent-child relationship during any periods they resided separately

I see tons of kids in streets in PI. Sleeping on the concrete at night. Coming up and begging for money or food during the day.

I rarely give them money, I heard they will just buy rugby with it.

I do however take numerous of them to jollibee for lunch or go to a sari sari store and buy all the candy they have and give it to the children

I think if more Americans knew how many street children lived in PI then they would adopt a lot more of them.

One could ask where YOUR source was found as you failed to give one. However your post spoke of adoption, it did not speak of IMMIGRATION and adoption. The Philippines allows US citizens to adopt family members from PI, but you failed to discuss whether that means they're eligible to immigrate.. and THAT'S the important part.

There are two adoption tracks:

- hague process

- orphan process

I did a quick google an PI is a part of the Hague process (by my understanding). Where it becomes a problem is that The US prohibits Adoption for the purpose of Immigration while it allows Immigration for the purpose of Adoption.

Here is the difference:

You want to Adopt a child in the Philippines. In order to adopt them they will have to immigrate to the US at some point: Immigration is to support the Adoption, perfectly legal.

OR:

You want to bring your niece to the US but can't petition her directly so you decided to Adopt her to create a Petition-able Relationship: This is Adoption for the purpose of Immigration and is consider Immigration Fraud as it's aim is to circumvent US Immigration Laws. If the child is an Orphan then there are provisions to allow it but with either of the parents still alive it smacks of Immigration Fraud as you are trying to bring an otherwise ineligible close relative into the US.

According to the INA, a child must meet the following two conditions in order to be considered an orphan:

1. The child must have no parents; or

2. The child has a sole or surviving parent who is unable to care for the child and has, in writing, irrevocably released the child for emigration and adoption.

Sorry about that, my source. Children Of All Nations Hague accredited COA my post was only a snippet on that subject of adoption

to TriplrG, I'll leave the immigrating aspect through adoption to more knowable people. If you go back and read my post under (Philippines Adoption Eligibility Requirements) you'll find " In addition to the USCIS eligibility requirements" do a quick 'Google' and you will find the information on eligibility/immigration as you did.
