Timeline

All our applications, NBC, and in Manila. Marilyn has the packet sent and we are ready but I do not have the money to make all this happen now. I do not want to just let it expire or call to cancel. I am afraid it will make it harder for approval when we can do this again. I will have gone past two years seeing her in October and will have to go see her again. How should I resolve this, and how should I explain how I can not pay for all this now? We are good, and I will see her again this next summer and reapply of necessary, but Help me with explaining the difference in time for us to complete all the approvals. There is nothing wrong with our relationship and she is going to school which will end in middle November. Application expires October 31.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

You are awaiting your interview date, yes? Can you not find anyone, anyone, to borrow the 355 from? If you can wrap up the visa part, your beneficiary has time before it must be used and you have to buy plane tickets etc. I would have had you wait to send the last packet in, but oh well.

If there is no way to get the 355, you can reschedule your interview date for later. I think with I-129f approval already secured, the two year meeting thing may not be an issue and you will simply have more time to get the money together. I believe the two-year meeting requirement is just for the initial petition, and will not become "expired" in this context. Someone can correct me if I'm wrong.

Someone may come by to shame you for not having enough money to handle the process. Don't worry. Poor people happen. But you are also capable of scraping things together, right? Mow every lawn in sight for the next two weeks and you can find 355 dollars. Ask a relative; ask a friend. Work at a gas station. Open a lemonade stand. You can do this. If you get visa in hand, you will save yourself some trouble and be able to sort the rest out. Good luck.

Generally they renew it automatically if its coming up on expiration but it hasnt gone to interview yet.

Usually only if the delay is caused by the embassy - not the immigrant.

If they miss dates or delay in sending back information requested, they embassy could declare it abandoned and send it back to USCIS.

The OP is in a pickle - since he doesn't have the money to make this happen (I am guessing he means the medical costs, visa costs, etc...) - that will not look good when they determine the affidavit of support, and his ability to keep the person off of means tested benifits.

you may need to just let this one slide, save some money, and restart the process over - however, one thing you can try is contact the embassy and see if they will delay the processing.

If it doesn't work, you will have your answer.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

It is not the $355, but plane fair and time to AOS.. more again. And the Medical, and she will have to travel to Manila for the interview. Things happened here that it is not available. Perhaps shame on me, but plans of mice and men often go astry. it is what it is, and we are good, but it will be next year about this time before I will be able to afford to get her here, not for her interview... Been married before? (smile) We have talked about this much since the change of monitary ability and are good with each other for the time. But a friend suggested to extend if it is possible, that perhaps if I cancel or let it expire, the possiblity of automatic disapproval is there when we reapply. Looking for ways to extend, Yes I would not want to use lack of funds for this either, it is embarrassing, but it is this way.

Hm well. That...sucks. I personally would still be looking at scrambling for medical and visa costs, myself. Plane and AOS are way future. But if you say so, it's so. If you cancel, you can file again. I don't think it will be a big deal. Don't be embarrassed though. It's your life and your circumstances. You'll do what you have to do.

I protest about getting it done because I was dirt poor as I sponsored, and it was hard going, but it was all that mattered. Not meant to question your desire to be with your loved one at all--just explaining my strenuous urgings to Do the Thing. Everybody's situation is different though, and perhaps you are being quite smart about getting yourself in a strong financial place and refiling.

Coupla comments -

1. you can ask that the 'validity of duration' on the I-129F approval notice be extended, via email to the IV unit in Manila.

2. she can delay sending the Packet 3 stuff back, usually anywhere from 3 to 12 months

3. the '2 year rule' applies from 'last meeting' to 'I-129F filing date', usually loosely tied around the I-797-C Receipt Date. I think you've met that '2 year rule' so yer ok.

4. if you want her to come in summer, do #2 and #1, concurrently, aim for interview date some time in March.

5. Once the visa is approved, barring any medical issues (these reduce this 'time') - she'll have 6 months from visa issuance date to come into the USA (this is printed on the visa, after approval, btw).

so, it IS possible to 'shift the calendar', but - you have to ask for something (validity of duration to be extended) and SHE has to send off Packet 3 much later than 'today'.

HTH ! Map out yer plan of attack, ask around - what I've described is not only do-able, but it's been DONE, for Manila.
