Hi everyone,

I am new to this site and this is my first post. I am a US citizen and recently came to Pakistan on Oct. 7, 2009. I got married on Dec 5, 2009. My husband and I are expecting our first child who is due on Dec 18, 2010. I have made a decision to go back to Houston to my parents for the delivery. I will come back to Pakistan in January. I dont know if i should file the petition from here in PK or from back home. I know the DCF rule is that i have to be resident in PK for 6 months. I came to PK on a visit visa but I applied for a NICOP(National Identity Card for Overseas Pakistanis) last month and I should be receiving that soon. So I will no longer need my visit visa. So what I need help about is should I apply from Houston or when I come back to PK? I know I will have to wait 6 months before applying. I think that it is better for me bc in Houston I do not have a job or a domicile...which would arise problems for us in the future. So what is the deal for the DCF? Do they not a domicile for DCF? My uncle who is in Houston is giving us both jobs at his store as soon as we get to Houston. Does that work for DCF? I need help ASAP.

Let me suggest something else, ya?

You've been in Pakistan since 7 OCT 2009, to current. The 'window' for DCF filing is based on yer legal presence in Pakistan, and NOT how long you've been married.

If it was April 12, 2010, you'd qualify to file 'on that date' because of the '6 month rule'.

As is, now, you could file this week, the I-130 to Islamabad, and then when the approval is issued, submit the DS-230 on yer husband and then leave Pakistan. it's OK not to be there for the interview, many USC Spouses decide to 're-establish domicile' and 'get a job in USA' after I-130 approval, not to return for interview day.

i called the US embassy in Islamabad at they told me that i can not file the petition here since i came on a visit visa. the man told me that i need to be a resident of pakistan in order to apply from here. he told me to make a NICOP.

im due in dec and i only have a month left to travel bc i want to travel before my 8th month starts so how will i have time to file it from here and send in the DS-230. i heard it takes a few months for the file to be approved, right?
