i've just sent my (1)bank statement and (2)employment letter, and of course the form I-134 to my fiancee in the Philippines. I just wanted to know if those were enough evidence for my I-134. I've read some VJ posts that they've also included a copy of their W2/income-tax-return with their form. Is that really necessary? since I was just following the instructions for the I-134 which only asks for it only if you're self-employed. Thanks!

The consul will want to see your 2009 income tax return, W-2's, and 1099's, as well as several recent paycheck stubs.

100% agree!!!...that's what they are looking for from you..recent W2s and Tax returns(at least the recent last two years)...and pay stubs...a friend here in Vj was given a 221g during her interview(not sure about the name) becoz they don't have paystubs...God bless!!

The preferred document are the tax transcripts from the IRS. Here is some information from the IRS how to obtain them.

You have two easy and convenient options for getting copies of your federal tax return information--tax return transcripts and tax account transcripts--by phone or by mail.

Request transcripts by calling 1-800-829-1040, or order by mail using IRS Form 4506T (Request for Transcript of Tax Return). We do not charge a fee for transcripts. Allow two weeks for delivery.

A tax return transcript shows most line items from your tax return (Form 1040, 1040A or 1040EZ) as it was originally filed, including any accompanying forms and schedules. It does not reflect any changes you, your representative or the IRS made after the return was filed. In many cases, a return transcript will meet the requirements of lending institutions such as those offering mortgages and for applying for student loans.

This is a common mistake.

The instructions for the I-134 are useless. They were written by USCIS. However, ever since the immigration reform act of 1996, USCIS rarely uses the I-134 anymore. Department of State still uses the I-134 for certain types of non-immigrant visas, including K visas, and they have their own rules. Most consulates require a copy of your most recent tax return or an IRS transcript of that return. Most consulates do not require bank statements unless you are self-employed.

This is a common mistake.

The instructions for the I-134 are useless. They were written by USCIS. However, ever since the immigration reform act of 1996, USCIS rarely uses the I-134 anymore. Department of State still uses the I-134 for certain types of non-immigrant visas, including K visas, and they have their own rules. Most consulates require a copy of your most recent tax return or an IRS transcript of that return. Most consulates do not require bank statements unless you are self-employed.

Thanks alot guys! So just the recent tax return or an IRS transcript will do? how about pay stubs from work? are they necessary? If they are, how many or how recent will they need to be?

I followed the instructions as you did (just bank letters and work letter) and had NO issues, not one, though Australia is a low fraud country, and it's not YOUR country so honestly my info is useless to you.

Anyone from YOUR country is the person to listen to, especially now as someone above listed that a 221(g) was issued whn someone didn't bring the tax returns. Trust others from your countries experience, they will know what your country requires (also I believe from memory it's listed on the Philippines website that a tax return etc is required)

During the prescreening at her interview, your fiancée will likely be asked to submit, among other things, photocopies of your 2009 income tax return and your 2009 W-2. She should have the original W-2 in her possession at the time of her interview in case the CO wants to see it. She should also have an extra photocopy of your income tax return in her possession. As a matter of fact, I agree with the VJ step-by-step guide: it's a good idea for her to have a duplicate of your entire K-1 packet with her at the time of her interview. Her copy of the packet should include original receipts. This is because the prescreener or the CO can ask her for anything from the packet. Also, the Embassy has been known to lose documents and it's good to have a backup. The Embassy lost some of our documents.

Again, you will need a 2009 federal income tax return or a 2009 income tax transcript. I sent both. Also, as I said earlier, you will also need paycheck stubs. Send three months worth of paycheck stubs. They should be your most recent paycheck stubs reasonably possible...within a month of the interview should be fine.
