Removal Proceedings

I have read a recent post where the member was mentioning Question #16 on I-130 which referred to "Immigration Proceedings"

Removal,Exclusion/Deportation,Rescission or Judicial Proceedings... can anyone give me some examples of these... I have reviewd these on several websites but see nothing definite.... :blink:

I honestly don't understand your confusion. The titles tell you what they are:

-- Removal proceedings - proceedings to remove you from the US

-- Exclusion proceedings - proceedings to exclude you from the US

-- Deportation proceedings - proceedings to have you deported from the US

-- Rescission Proceedings - proceedings to have your status in the US rescinded (i.e. revoked)

-- Judicial proceedings - proceedings in a court room. Given it refers to "immigration proceedings" I would assume this refers to any other court proceeding involving your immigration status

the "from the US" is inferred as this is a US document regarding US immigration, any other countries immigration is irrelevant to US paperwork

AOS Timeline from F1

Sent AOS on April 17

Received and signed on April 19

Got 3 NOAs April 26

Biometrics Appointment Letter received May 1 - dated May 26

Walk-in biometrics rejected May 12

Biometrics Appointment May 26

Interview letter received June 11 - for July 19 APPROVED

EAD Received July 9

GC RECEIVED August 2

oooohhh okok. I thought you were asking for a definition.. now it makes more sense :D

well honestly several things can cause you to be in removal/deportation etc. For example:

- you are overstaying your visa (there are some exceptions to this overstay rule, like a K1) and ICE catches you. They would put you in removal/deportation proceedings.

- you apply for AOS based on marriage to a USC, but they determine your marriage is fake and deny your application. You usually get time to appeal this and if you don't appeal in time, removal proceedings will commence

- If you get an RFE and don't reply in time, they deny your application and again, removal proceedings commence.

There are other things like violating the terms of your visa, and all other sorts of rules. The best way to find out what actually applies to you is to look at your specific visa, or application process. With AOS the main concern is replying to RFE's on time and proving your marriage is real. Of course criminal acts can also affect the process but these are usually massive issues.

Is there something in particular you're worried about? It's rare to get in removal proceedings etc as long as you follow the rules and do what you're supposed to.
