Hi Guys! I am very new to this site so please bare with me. My problem is, my fiancee- my future wife had her interview august 25th and was given a blue slip requesting evidence of my current sustained income. :crying: I am self employed and have established a cleaning business although I have not filed a tax due to the date of my business registration. The business was registered january 2010 and my filing date is not until january of 2011. Although, I do have a copies of contracts with my current clients. 1 contract is with an adult home who i have been hired as their maintenance manager and 2 residential contracts. Please somebody tell me if these are enough to submit to the consul.

1. Business Certificate/ Registration

2. Tax Number

3. Tax letter from WA state stating my filing date is not until jan. 2011

4. Contracts with my client

5. Invoices from the past few months I have been working with them

Now you might be asking if i do have w2-s or tax return last year or previouse years. I DON'T. I was a full time student and just finished school late 2009 and soon as i got out, i worked on this business. Another worry that i have is. I am only making about $1100-1200 a month which would place me about $14400 a year since my business is still new. actually I might meet the poverty guideline but would they know or will they foresee it like i do? because I have only started earning this june. I also have my cousin as a co-sponsor just in case.

Anything helps!!! Thanks guys =( im just so worried. She is going back maybe next week to submit all these documents.

If your "current" annual income does not make the poverty level needed, you will need a co-sponsor.

They will not assume you will make more down the line, they are only concerned that you make enough at the time of the filing.

So - from the info you posted - you should look into getting one lined up, in case they do not accept your info.

BTW - what info did you submit with the I-134 initially?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

It wouldn't hurt to have your clients write a letter of agreement. It should show when the contract started, what the contract is for, how long the contract will go on, how much the contract pays and how ofter you have to perform your duties. This could take the place of an employment letter.

Your current sustained income is well below 125% of the poverty line.

Therefore, you need to submit all of the documents you listed, as well as a letter which clearly states your circumstances.

However, most importantly, you need a qualified co-sponsor. If I were in your shoes, I would use a co-sponsor that is a closer relative than a cousin. A parent or a sibling would be better. I would also submit an I-864 from that co-sponsor rather than their I-134.

Also, I would make doubly certain that your fiancée is well aware of the importance of the financial case you're trying to make. She needs to understand your strategy in making your case, and she needs to make certain that the Embassy accepts all of the documents of your financial case when she submits it.

@Bobby+ Umit: I134 "I drive an annual income of.... (if self employed attach a copy of my last tax return or report of commercial rating concern) - Well my lawyer said not to put anything because I am self employed? which i find it a little weird. Do you think I should put the amount i would be making in total for the year? they haven't seen my i134 because i submitted i864 by mistake. So now its coming with all other documents.

@normAndGrace: I appreciate your reply! i am submitting contracts which states how long i will be working for them and how much i am charging together with their signatures.

@Tahoma: Hi! I have also made a cover letter stating my circumstances! and i would have picked my dad but he just filed bankruptcy few years ago and i don't want that to mess it all up plus my cousin ears way so much more where to my dad is only making $13an hr. I am just hoping they would go through all the documents and my cover letter that way they would somehow understand my situation. :wacko: and i will make sure my fiancee could explain this well.

I like the idea of a cover letter that explains your circumstances because the CO's don't always put two and two together from the pile of documents sitting in front of them. A cover letter will help them see the big picture.

The USEM appears more likely to accept cosponsors from young college graduates. I would submit an I-864 from your cosponsor rather than an I-134. In my opinion, this would show the CO that when it comes time for you to AOS, you are likely to have a needed cosponsor. More importantly, it shows the CO that it is less likely that your fiancée will become a public charge. An acquaintance of mine who was in the same situation as you was successful in getting his fiancée a fiancée visa from the USEM using this strategy.

Unless something has changed recently, the Phillipines does not accept co-sponsors for for K-1 visas as a general rule. I have heard of them accepting a co-sponsor sometimes IF it is an immediate family member. For this reason some people get married first and file for a CR-1 where the affidavit of support is reviewed by NVC and joint sponsors are allowed and can even combine incomes on the I-864/I-864A.

The documents listed by the OP are good ones, also a bank letter showing deposits to your PERSONAL account.

Remember, a contract represents gross REVENUE for a business. Business revenue does not qualify a person, it must be PERSONAL INCOME. Even if it is a sole proprietorship and the business is in the owners name, the contract is still gross revenue, not personal income. For a self employed person his personal income is that which is claimed on line 22 of the 1040 form AFTER deductions for business costs and expenses.

1. Your lawyer is wrong. Big surprise. You HAVE income.

2. Contracts show how much they pay the business, you need to show how much the business pays YOU. YOU are sponsoiring your fiancee, the business is not sponsoring your fiancee.

3. Your father's bankruptcy is of no consequence whatever. They will go by his current income ONLY. There is no credit check. PI's is more likely to accept your father as co-sponsor for a K-1 than anyone else. Use him. $13 per hour is $27,040 per year (full time) and that is plenty to sponsor even a family of four. He needs to be able to support himself and your fiancee. (2) PLUS any dependent children. YOU are not a dependent child. Your mother (or his wife depending on his marital staus) is not a dependent, she would be an adult US citizen and soes not need a sponsor and is not dependent unless she is handicapped and claimed as such on his income tax.

My fiance went back the other day to the embassy to submit the evidence of "current sustained income". I tried filing a tax early and everything but they won't let me because it is too early and the first tax I should file is the anual tax return from when my business was registered. Therefore I have only submitted the tax letter from washington state saying when my first tax return should be filed which is not til january 2011.

I did add my dad as my cosponsor and so is my cousin still

I had both i134 and i864 from my joint sponsors. Unfortunately the lady who takes the documents in - returned the i864s but took the i134s. Now they said to wait 1-2 months for decision to be mailed. Is that how long it usually takes?

I-864 is not normally used with the K1 petition. USEM uses the I-134, that's why the I-864 was not accepted.

Hi - what was in the packet of evidence of "current sustained income" ? If you didn't include stuff from post #8, then why not include stuff from post #8 ?
